Legislative Framework  National Environmental Management Act, 1998 – regulatory framework for the management and protection of environmental resources and coordination in relation thereto.  World Heritage Convention Act, Act 49, provides for the cultural and environmental protection and sustainable development of, and related activities in a world heritage site.  National Environmental Management: Protected Areas Act, regulates protected areas in South Africa.  National Environmental Management: Air Quality Act, regulates air quality  National Environmental Management: Biodiversity Act, regulates and sets out the mechanisms for managing and conserving South Africa’s biodiversity, its components and institutions  National Environmental Management: Waste Act, regulates waste management; provides for national norms and standards for regulating the management of waste by all spheres of government; and provides for the licensing and control of waste management activities.  National Environmental Management: Integrated Coastal Management Act, 2008 (Act No. 24 of 2008) - establishes a system of integrated coastal and estuarine management in the Republic; ensures that development and the use of natural resources within the coastal zone is socially and economically justifiable and ecologically sustainable; determines the responsibilities of organs of state in relation to coastal areas; controls dumping at sea, pollution in the coastal zone. 4

Overview of Functions/ Programmes Administration: provide strategic leadership, centralised administration & executive support, corporate services and facilitate effective co-operative governance, international relations, environmental education and awareness Environmental Quality and Protection: protect and improve the quality and safety of the environment to give effect to the right of all South Africans to an environment that is not harmful to their health and wellbeing Oceans and Coastal Management: Ensure that government, industry and the public are informed, supported and regulated to act responsibly to conserve the ocean and coastal environment as well as to honour South Africa’s local and global obligations Climate Change: Promote, coordinate and manage an effective national mitigation and adaptation response to climate change Biodiversity & Conservation: promote the conservation and sustainable use of natural resources to contribute to economic growth and poverty alleviation. Environmental Sector Programmes and Projects: Implement environmental sector projects and assist in job creation 5

On the basis of the mid-term review which indicated that there is a steady progress in various areas such as health, education, the fight against crime, human settlements, energy, water provision, rural development and others. The department will continue with implementation of programmes linked to all Priority areas and intensify interventions in the following areas which still pose major challenges: –HEALTH: Large % of child mortality still linked to poor indoor air quality (respiratory illnesses), waste management practices (diarrhea & vector borne diseases) –EDUCATION: Implementation of the Sector Human Capital Development Strategy with targeted interventions at schools & higher education institutions –FIGHT AGAINST CRIME & CORUPTION: Strengthen compliance and enforcement initiatives, promote & uphold DEA Values. –HUMAN SETTLEMENTS: Basic waste services provision (finalisation & implementation of outcomes of the Waste Services study), Climate change adaptation and resilience programmes We will contribute to the national development plan which focuses on the elimination of poverty and inequality through targeted inequality aversion measures through the Green Fund, Green Cities and EPWP programmes Link to Government Priorities

Response to SONA PriorityDepartmental Response Infrastructure development To ensure infrastructure development takes place in an environmentally responsible and sustainable manner, the department will ensure that there are adequate instruments to improve efficiency and effectiveness of environmental impact assessment system across the country. These will include Development of Environmental Management Frameworks (EMFs) where certain areas are identified as critical development areas with increasing development pressures. The Department is in the process of developing the following spatial systems and tools to assist in the evaluation of proposed developments:  GIS System to identify sensitive environments; and  Norms and standards to facilitate development applications. Job creation Through our Environmental Sector Programmes and Projects programme, the Department will continue with an intensified implementation of the Expanded Public Work Programme (EPWP) for the Environment and Culture Sector. In 2012/13 we plan to create a total number of new work opportunities, full time equivalents job and ensure that a significant number of unemployed women, youth and small, medium and micro enterprise (SMMEs) continue to benefit from our programmes. Green Economy Fast-tracking the regulatory framework for the green economy in order to unlock potential for growth and employment creation Facilitate implementation of the Green Fund programme in collaboration with Development Bank of Southern Africa (DBSA) Implementation of Green Cities Support Program Mining The Department forms part of the Intergovernmental Task Team and the Project Executive Committee and ensure that the rehabilitation of land as a result of acid mine drainage is done in accordance with the National Environmental Management Act. Facilitate implementation of the Biodiversity Act and Section 48 of the National Environmental Management : Protected Areas Act in order to improve decision-making on which sensitive areas should be protected and where compromises could be reached.

Programme 1 Priorities Strategic Objective:Equitable and Sound Corporate Governance Compliance with statutory tabling and prescripts; effective risk management and performance and financial management (Unqualified audit report) Strategic Objective: Improved Access to Information Resolving Presidential Hotline queries within timeframes (within 3 working days); responding to Parliamentary questions, information sharing through publications, media briefings; and public participation events. Strategic Objective: Adequately and appropriately skilled staff Managing vacancy and turnover rates; training and development of staff Strategic Objective: Secure, harmonious, transformed and conducive working environment Resolving labour matters and implementing interventions aimed at improving the wellbeing of employees; ensuring achievement of employment equity targets; New Head Office Building (Green building); and compliance to security legislation and directives Strategic Objective: Efficient and Effective Information Technology Service Implementation of the reviewed and approved Master Systems Plan (MSP) 12

Programme 1 Priorities … Strategic Objective: Effective Legal Support Appeals; compliance with the implementation of PAIA; litigation; contract management (vetting); application of environmental legislation and internal policies Strategic Objective: Improved Sector Education and Awareness Roll-out of the Learnership programme; conduct environmental education and awareness workshops in all provinces; establish environmental centres; Training of Environmental Management Inspectors; Facilitating environmental awareness campaigns and training beneficiaries on the people and parks toolkit (an initiative to promote biodiversity management at local government level) Strategic Objective: Effective knowledge and information management for the sector Second South African Environment Outlook (SAEO); developing and implementing Enterprise GIS completed; Analysis of compliance with performance measures & development of a stringent monitoring mechanism in cooperation with National & Provincial Treasuries; Annual State of the Oceans; peer reviewed scientific publications and development of an online ocean and coastal information system initiated 13

Programme 2 Priorities Strategic Objective: Improved compliance with environment legislation complaints and incidents processed and investigated; compliance inspections conducted; enforcement actions (directives, criminal investigations and finalisation of dockets); development and implementation of tools to measure levels of compliance; implement the national strategy for safety and security of rhinoceros Strategic Objective: Potential negative impacts of all significant developments prevented or managed Processing of EIA applications within prescribed timeframes; develop and implement environmental management instruments to assist provinces and municipalities in environmental impact management and aid spatial planning; implement the Environmental Assessment and Management Strategy; develop and implement tools on mitigating impacts of development on biodiversity (mining in sensitive areas) Strategic Objective: Less waste that is better managed Bringing into effect part 8 of Chapter 4 of the Waste Act (through development and implementation of instruments i.e. regulations, guidelines etc); increase in recycled and recovered waste, establishing buyback facilities; Basic waste services provision; remediation of land; permitting of waste disposal sites 15

Programme 3 Priorities Strategic Objective: Established management frameworks and mechanisms for the ocean and coastal environment Ocean management regime developed (Oceans policy, Southern Oceans and sub-Antarctic management strategy, Oceans and coasts spatial plan etc); relief voyages to Antarctica and Islands; oil pollution emergency response, estuary management, increase of coastline under protection; management plans for marine protected species) Strategic Objective: Strengthened national science programmes for integrated oceans and coastal management Research (coastal and on marine top predators); ocean and coastal observation and monitoring network. 16
