1 PORTFOLIO COMMITTEE PRESENTATION OVERVIEW OF STRATEGIC PLANS OF THE DEPARTMENT OF ENVIRONMENTAL AFFAIRS AND ITS ENTITIES

2 LEGISLATIVE FRAMEWORK FOR PLANNING
National Treasury regulations: Chapter 5 (Department) & Chapter 3 (Entities) Prepare a strategic plan with a five year planning horizon Table annual performance plans with a three year horizon consistent with the Medium Term Expenditure Framework Money Bills Procedure and Related Matters Amendment Act, 2009 (Act No 9 of 2009) strategic plans must be tabled after the adoption of the fiscal framework. According to the parliamentary programme for the first term of 2013, as agreed to by the Joint Programme Committee, the fiscal framework is scheduled for adoption on 12 March 2013 in the National Assembly. The date for the submission of updated strategic plans and annual performance plans is therefore commencing from 13 March However, for the smooth running of incoming strategic plans and annual performance plans and to ease the logistical challenges, strategic and annual performance plans to be submitted on Monday, 11 March 2013 Public Service regulations: Part 3 B Based on the strategic plan of the department, an executing authority shall determine the department’s organisational structure in terms of its core and support functions; grade proposed new jobs according to the job evaluation system; define the posts necessary to perform the relevant functions

4 Legislative Framework
National Environmental Management Act, 1998 – regulatory framework for the management and protection of environmental resources and coordination in relation thereto. National Environmental Management: Protected Areas Act, regulates protected areas in South Africa. (SANParks) National Environmental Management: Air Quality Act, regulates air quality National Environmental Management: Biodiversity Act, regulates and sets out the mechanisms for managing and conserving South Africa’s biodiversity, its components and institutions (SANBI) National Environmental Management: Waste Act, regulates waste management; provides for national norms and standards for regulating the management of waste by all spheres of government; and provides for the licensing and control of waste management activities. National Environmental Management: Integrated Coastal Management Act, 2008 (Act No. 24 of 2008) - establishes a system of integrated coastal and estuarine management in the Republic; ensures that development and the use of natural resources within the coastal zone is socially and economically justifiable and ecologically sustainable; determines the responsibilities of organs of state in relation to coastal areas; controls dumping at sea, pollution in the coastal zone.

Administration: Provide leadership, strategic centralised administration and executive support, corporate services and facilitate effective cooperative governance, international relations and environmental education and awareness Legal, Authorisations and Compliance: Promote the development of an enabling legal regime, licencing/authorisation system that will promote enforcement and compliance. Oceans and Coasts: Promote, manage and provide strategic leadership on oceans and coastal conservation Climate Change and Air Quality Management: Improve air and atmospheric quality, lead and support, inform, monitor and report efficient and effective international, national and significant provincial and local responses to climate change (South African Weather Service) Biodiversity and Conservation: Ensure the regulation and management of all biodiversity, heritage and conservation matters in a manner that facilitates sustainable economic growth and development.(South African National Parks, South African National Biodiversity Institute, Isimangaliso Wetland Authority Park) Environmental Programmes: Implementation of expanded public works and green economy projects in the environmental sector. Chemicals and Waste Management : Manage and ensure that chemicals and waste management policies and legislation are implemented and enforced in compliance with chemicals and waste management authorisations, directives and agreements.

16 SANPARKS A Public Entity functioning under National Environmental Management: Protected Areas Act 57 of 2003 Mandate of SANParks To conserve, protect ,control and manage national parks and other defined protected areas and their biological diversity (biodiversity);

17 SANBI Established on 1 September 2004 in terms of the National Environmental Management: Biodiversity Act (Act 10 of 2004). The mandate of SANBI To play a leading role in South Africa’s national commitment to biodiversity management, now and into the future.

18 iSimingaliso Wetland Park
Established in terms of the World Heritage Convention Act 1999 (Act No 1 of 1999)- inscribed as a World Heritage site In December 1999 Mandate To protect, conserve and present the Park To promote and facilitate optimal tourism and related development in Park To empower historically disadvantaged adjacent communities

21 PUBLIC ENTITIES GOVERNANCE AND OVERSIGHT

22 PLANNING & REPORTING REQUIREMENTS
Submit a budget of estimated revenue and expenditure for approval by the Minister (End of September each year). 1st Draft Strategic Plan (Mid August each year for Submission to treasury and Department of Monitoring and Evaluation) 2nd Draft Strategic Plan (Mid November for analysis by department and submission to treasury and Department of Monitoring and Evaluation) Strategic Plan finalised for submission to the Minister (End of January each year). According to Treasury Regulations The Minister may request additional information to be included in the Entity’s strategic plan. These may include special requirements in allocation letters of entities.

23 PLANNING & REPORTING REQUIREMENTS
Should the approved strategic plan be amended, the Minister must approve those amendments DEA provides planning and reporting templates to entities. However, entities are at liberty to customise template but ensure coverage of the required fields DEA develops an overarching Human Resource Management Framework for the entities. However it is it is the responsibility of each entity to develop their own specific human resource management plan Quarterly reporting on the extent of compliance with the PFMA (Financial performance) Quarterly reporting with regard to effective performance Quarterly monitoring of Compliance to special conditions stipulated in allocation letters Annual Financial Statements: end of May to Auditor-General Annual Report end of August to Parliament

24 GOVERNANCE, ROLES AND RESPONSIBILITIES
Board Members are appointed in terms of relevant legislation A departmental representative to be a permanent member of the Entities’ boards The roles and functions of each Board are determined by the Act that establishes the Entity CEOs of Entities are appointed by cabinet on Minister’s recommendation. The department facilitates the process Minister may add special requirements in allocation letters of entities. DEA CFO should to remain an ex-officio member of Entities’ audit committees as her role is to represent the interest of the department (the extension of DEA) & provide oversight for the department
