Thomas Jefferson 3 rd President (Republican) & Aaron Burr was Vice President

12 th Amendment requires electors to vote for the president and Vice President on separate ballots

Jefferson’s Goals -wise & frugal government the support of state governments in all their rights reduce the power of the federal government

Jefferson & the courts much of the bitterness between the Federalists & Republicans resulted from a fight over control of the federal courts

Marbury v. Madison - John Marshall (chief justice) – extended the power of the court & broadened federal power at the expense of the states

Marbury v. Madison Continued - established JUDICIAL REVIEW 1. Constitution is the Supreme Law of the Land 2. When there is a conflict between the law & the constitution, the Constitution must be followed 3. The Judicial branch has a duty to uphold the Constitution
