SECTIONS 5310, 5316 AND 5317 PROGRAM GUIDELINES AND REQUIREMENTS The Governor of South Carolina has designated the South Carolina Department of Transportations (SCDOT), Division of Intermodal and Freights Office of Public Transit, as the recipient of all Federal Transit Administration (FTA) funds to administer in accordance with state and federal laws, statues, and regulations; This program is authorized under the provisions set forth in the Safe, Accountable, Flexible, and Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) which was enacted August 10, 2005; (Currently operating under a continued resolution.)

SECTION 5310 PROGRAM GUIDELINES AND REQUIREMENTS Program Overview Provides formula funding to states for the purpose of assisting private nonprofit groups in meeting the transportation needs of the elderly and persons with disabilities when transportation service provided is unavailable, insufficient, or inappropriate to meeting these needs; Funds are apportioned based on each states share of population for these groups of people;

SECTION 5310 PROGRAM (Continued) SCDOT ensures that the local applicants and project activities are eligible and in compliance with federal requirements, that not-for-profit transportation providers have an opportunity to participate as feasible, and that the program provides for as much coordination of federally assisted transportation services, assisted by other federal sources;

SECTION 5310 PROGRAM (Continued) This program at a minimum must be derived from a coordinated plan; SCDOT and a committee of regional COG representatives has developed ten coordinated plans to meet the SAFETEA-LU requirements; Currently being updated, additional information forthcoming.

SECTION 5310 PROGRAM (Continued) Eligible Subrecipients Private non-profit organizations, governmental authorities where no non-profit organizations are available to provide service and governmental authorities approved to coordinate services. Eligible Projects Funds for this program are available for capital expenses to support the provision of transportation services to meet the special needs of the elderly and individuals with disabilities;

SECTION 5310 PROGRAM (Continued) Allowable projects include: Purchase of Services (POS) ADA Vehicles (Cutaway Bus or ADA Mini-Van) None ADA Mini-Van (*special approval required) Wheelchair lifts and restraints *Due to rising gasoline prices, non-ADA mini vans are allowable, but only if your fleet meets ADA guidelines.

SECTION 5310 PROGRAM (Continued) FLEET MANAGEMENT SCDOT establishes minimum useful life standards to ensure vehicles and other equipment are maintained for transit use; Vehicle useful life begins on the date the equipment is placed into revenue service, and continues for as long as it is in service; All agencies are required to have a preventive maintenance plan and track routine PM check- ups.

SECTION 5316 JOB ACCESS AND REVERSE COMMUTE (JARC) PROGRAM GUIDELINES AND REQUIREMENTS Overview JARC established through TEA-21 to address unique transportation challenges faced by low income individuals; Has had a dramatic impact on the lives of thousands of welfare and low-income families; helping them transition from welfare to work and reach needed employment;

SECTION 5316 JOB ACCESS AND REVERSE COMMUTE (JARC) PROGRAM GUIDELINES AND REQUIREMENTS Overview With the passage of SAFETEA-LU, JARC funding was allocated by formula based on population; The formula is based on the number of eligible low- income and welfare recipients in an urbanized or rural area. South Carolinas distribution methodology is based on Census data within a COG Region along with Rural and Small Urban funding eligibility criteria.

SECTION 5316 JOB ACCESS AND REVERSE COMMUTE (JARC) PROGRAM GUIDELINES AND REQUIREMENTS Eligible Recipients A. Private non-profit organizations B. State or Local government authority; and C.Operators of public transportation services; including private operators of public transportation services. Eligible Activities Capital, planning, operating expenses that support the development of maintenance of transportation services designed for program objectives.

SECTION 5316 JOB ACCESS AND REVERSE COMMUTE (JARC) PROGRAM GUIDELINES AND REQUIREMENTS Project Options Capital Vehicles Intelligent Transportation Systems (ITS) Mobility Management Regional Projects preferred, distribution of funds based on availability and not guaranteed, All projects need to move towards Mobility Management Programs, No reimbursements will be approved without project summary.

SECTION 5317 NEW FREEDOM PROGRAM GUIDELINES AND REQUIREMENTS Overview Authorized in SAFETEA-LU to support public transportation services and alternatives beyond those required by Americans with Disability Act of 1990 Derived from Executive Order stating the United States is committed to community based alternatives for individuals with disabilities……

SECTION 5317 NEW FREEDOM PROGRAM GUIDELINES AND REQUIREMENTS Overview New Freedom aims to overcome existing barriers to individuals seeking integration into workforce and full participation in society; Geographic disproportions of transportation- disadvantaged populations also creates challenges for human service programs; South Carolinas 10 Regional Coordination Plans and partnerships with its 10 Regional COGs assist with bridging this gap.

State or Local government authority; and C.Operators of public transportation services; including private operators of public transportation services. Eligible Activities Capital and operating expenses that support new public transportation services beyond those required by the ADA Act of 1990

SECTION 5317 NEW FREEDOM PROGRAM GUIDELINES AND REQUIREMENTS Examples of New Public Transit Services Beyond ADA Enhancing paratransit beyond minimum requirements of ADA. ADA complimentary paratransit services can be eligible, but must meet definition of new (August 10, 2005) Feeder Services New feeder services (transit service that provides access) to commuter rail, commuter bus, intercity rail, and intercity bus stations, for which complementary paratransit service is not required under ADA

SECTION 5317 NEW FREEDOM PROGRAM GUIDELINES AND REQUIREMENTS Examples (continued) Accessibility Improvements to transit and intermodal stations not designated as key stations Travel Training New training programs for individual users on awareness, knowledge, and skills of public alternative transportation options ADA Vehicles (ADA mini-van on state contract 2012) Voucher Programs Volunteer Driver and Aide Programs Mobility Management, same restrictions as JARC

SECTIONS 5310, 5316 AND 5317 PROGRAM REQUIREMENTS AND ACCOUNTABILITY Office of Public Transit (OPT) is responsible for oversight and compliance of these programs. Public Providers receiving any of the funds above will be reviewed during your 5311 compliance review. All other providers will be reviewed every three years.

SECTIONS 5310, 5316 AND 5317 PROGRAM REQUIREMENTS AND ACCOUNTABILITY All recipients will be required to submit the new Human Service Compliance Review Form. This form will provide information required for necessary federal quarterly reports and assist with managing projects. Please see handout for a glimpse of the draft form.
