context Location OCP THE DEVELOPMENT SITE IS LOCATED AT 2301-2307 CLARKE STREET BETWEEN CLARKE AND SPRING STREETS, EAST OF ELGIN STREET. SURROUNDING USES CONSIST OF A MIX OF SINGLE FAMILY, ADAPTIVE COMMERCIAL, LIGHT INDUSTRIAL AND ST. ANDREWS CHURCH IS LOCATED TO THE SOUTH. THE PROPERTIES ARE DESIGNATED MULTI-FAMILY RESIDENTIAL IN THE OCP WHICH PERMITS TOWNHOUSE DEVELOPMENT UP TO 3 STOREYS IN HEIGHT. implementation Rezoning Bylaw 3161 Housing Agreement Bylaw 3162 establishes permitted uses and development regulation Housing Agreement Bylaw 3162 prohibits rental restrictions Development Permit establishes the form and character of development TO IMPLEMENT THIS PROJECT, BYLAW 3161 PROPOSES TO REZONE THE SITE FROM RS1 TO CD74 AND THAT NEW ZONE ESTABLISHES THE PERMITTED USES AND DEVELOPMENT REGULATIONS A HOUSING AGREEMENT IS ALSO PROPOSED TO ENSURE THAT THE FUTURE STRATA COUNCIL CANNOT ENACT REGULATIONS TO PREVENT OWNERS FROM RENTING THEIR UNITS IF THE REZONING PROCEEDS, BOTH BYLAWS 3161 AND 3162 WILL BE CONSIDERED FOR ADOPTION WHEN A DEVELOPMENT PERMIT IS READY TO BE CONSIDERED. THE KEY ISSUE AT THE CPAC MEETING WAS THE INABILITY FOR HANDICAPPED PERSONS TO ACCESS THE COURTYARD AND THE PROPOSED ADAPTABLE FLATS. THE PROJECT NOW INCLUDES AN ACCESSIBLE LIFT AND ADDITIONAL HANDICAPPED PARKING SPACES TO CONCLUDE YOUR WORSHIP, THE PROJECT COMPLIES WITH THE OCP LAND USE AND BUILDING HEIGHT POLICIES AND IT PROVIDES AN ALTERNATE FORM OF HOUSING INCLUDING SOME FAMILY UNITS.
