1) What Constitutional problem might the purchase present? What did Jefferson decide? 2) What new problems might the LA Purchase present for the US and Native Americans?

 President did not have Constitutional authority to purchase land. Jefferson & supporters decided it was inherent power of president.  Increased conflict with natives in territory.

 Read actual journal entries of Lewis & Clark, answer 3 questions. How does this compare to your “journal entries”?  Complete reading Sacagawea. Answer questions at the end.

What were “midnight judges” and why did Adams appoint them?

 Judiciary Act of 1801 – Feds passed before Jefferson became president so Adams could appoint more judges (Midnight Judges)  Not all judges received their commissions before Adams left office, so they were unable to take office  William Marbury sued Jefferson’s Secretary of State James Madison for refusing to deliver his paperwork, used Judiciary Act of 1789 as basis.

 Q: What was the decision of the Supreme Court and how did it relate to the system of checks and balances?

 John Marshall (Adams’ Sec of State who had failed to deliver commissions) was now Chief Justice  SC decided that Judiciary Act of 1789 was unconstitutional – Const. does not give Supreme Court the power to force Executive Branch to deliver paperwork  Affirmed judicial review and showed checks & balances worked.
