1 - Issuing regulations Governmental, Legal and Regulatory Framework for Safety (GSR – Part 1) Requirement 1: National policy and strategy for safety The government shall establish a national policy and strategy for safety…(paras 2.3, 2.4) Requirement 2: Establishment of a framework for safety The government shall establish and maintain an appropriate governmental, legal and regulatory framework for safety within which responsibilities are clearly allocated. (paras 2.5, 2.6) Indicate: Who are the regulators for different modes of transport in your country, Legal Entities of Public Law under the umbrella of the Ministry of Economy and Sustainable Development of Georgia - Civil Aviation Agency, Maritime Transport Agency, Land Transport Agency. In case of transportation of radioactive materials,

What regulations are in force in each case, and Law on management and regulation of transport sector; The air code; Law on road transport; Maritime Code; Law on Nuclear and Radiation Safety; The railway code;

1 - Issuing regulations The order №1-1/883 of the Minister of Economy and Sustainable Development of Georgia on list of technical regulation in the transport sector; What is the review process applied – For the transportation of nuclear materials, radioactive sources, and radioactive waste special license should be granted. To obtain a license, the license applicant shall submit an application in writing to the Ministry of Environment and Natural Resources Protection. Applications shall be submitted, considered, and filed for processing in the manner laid down by the Law of Georgia on Licenses and Permits. In addition to the application required by the Law of Georgia on Licensees and Permits, the license applicant should submit documents required by the law on Nuclear and Radiation Safety.

2 - Monitoring of transport operations To monitor transport operations it is necessary to know the magnitude of the transport in the country. Please indicate: Radioactive materials used in your country - In nuclear medicine: 131I, 125I and 99mTc. In industry: 137Cs, 192Ir, 60Co, 226Ra, 241AmBe, 252Cf Type and quantity of facilities using radioactive materials - Nuclear medicine, Brachytherapy, industrial radiography, well logging. (tens of facility) Types of packages used - The country has not package approval system. Mainly used B or A type packages. For orphan sources hand made packages are used. Number of packages transported by year - 20-30.

2 - Monitoring of transport operations More relevant shipments Point of entry, exit, transit routes - Airports, naval ports Who can inspect packages/shipments 1. On road – Emergency and Crisis Management Department of the Ministry of Internal Affair and Department for Nuclear and Radiation Safety of the Ministry of Environment and Natural Resources Protection; 2. At sea ports and on ships - The Legal Entity under Public Law within the Ministry for Finance of Georgia - the Revenue Service and its Costums Department and Department for Nuclear and Radiation Safety of the Ministry of Environment and Natural Resources Protection; 3. At airports and on aircraft - The Legal Entity under Public Law within the Ministry for Finance of Georgia - the Revenue Service and its Costums Department and Department for Nuclear and Radiation Safety of the Ministry of Environment and Natural Resources Protection;

3 - Import-export of radioactive materials Transport regulations assume there is an established framework to regulate activities involving radioactive material. As transport is involved in every import/export operation, it is important to know which are the requirements for import/export, e.g.: Notifications: Consignor, Consignee, Dates, routes, final destination Certificates Dangerous goods declaration, Approval certificates for packages / materials Inspections What inspections are required if any? Who inspects what? Prepare a detailed list of requirements for import/export of radioactive materials in your country. Include all the organizations involved.

3 - Import-export of radioactive materials Export-import of any not exempted radioactive source or not cleared radioactive material requires issuing of special permit granted by the Ministry of Environment and Natural Resources Protection. The permit is granted for defined period of time. All information of the permit should be sent in electronic format to the Customs Department. Granting a permit for export of radioactive materials shall imply: a) the consignor’s notification on sending radioactive materials; b) the consignee’s assurance on receiving the radioactive materials; c) a copy of the license of the carrier of the radioactive materials; d) information on the specifications of the radioactive materials to be carried and on the specifications of the protective containers;

3 - Import-export of radioactive materials e) ensuring the safety and physical protection of radioactive materials during transportation. Granting a permit for the export of nuclear material shall additionally imply: a) fulfillment by the consignee and consignor of international obligations under the Nuclear Non-proliferation Safeguards for nuclear materials; b) transportation of nuclear materials in accordance with the international obligations under Nuclear Non-proliferation Safeguards. Granting a permit for import of radioactive materials shall imply: a) holding by the consignee of radioactive material of a license for nuclear and radiation activity;

3 - Import-export of radioactive materials b) information on the specifications of the radioactive materials to be transported and of the protective containers; c) ensuring the safety and physical protection of radioactive materials during transportation. Granting a permit for import of nuclear material shall additionally imply: a) fulfillment by the consignee of international obligations under Nuclear Non-proliferation Safeguards for nuclear materials to be received; b) transportation of nuclear materials in accordance with the international obligations under Nuclear Non-proliferation Safeguards. The Ministry of Environment and Natural Resources Protection shall provide control over the fulfillment of permit conditions.

4 - Establishing responsibilities GSR-Part 1, para. 2.5(6) “…The framework for safety shall set out the following: … (6)Provision for assigning legal responsibility for safety to the persons or organizations responsible for the facilities and activities, and for ensuring the continuity of responsibility where activities are carried out by several persons or organizations successively…” How are the responsibilities established in your country for the transport of radioactive material? - The responsibilities are defined by license conditions based on national regulations. The new regulation for transport of radioactive substances is under the process of elaboration.

5 - Training and distribution of information Transport regulations in paras 311 to 314, and GSR Part 1 in Requirement 36, establish provisions for training and communication. Is the appropriate training available (for all modes of transport) For Consignors - by International organizations For Carriers - by International organizations For First Responders - National trainings are provided in general manner For Radiation Workers - by International organizations For Regulators - by International organizations

6 - Emergency planning and exercises Transport regulations rely on national provisions to respond to an emergency or incident. Do you have a national response plan? - The response plan is defined by the order of the president N415. Is response to transport accidents/incidents covered in that? - Transport accident is considered Are the proper authorities involved? - The order considers involvement of proper organizations defining the main responsible ministries. Is the appropriate equipment available? - Georgian authorities have great experience on response on accidents involving orphan radioactive sources. Therefore the agencies have proper equipment to respond on accident in transport.

6 - Emergency planning and exercises Are responders properly trained? Do you have notification requirements? – Notification requirements are considered by the regulation. What about members of the public? – By the national regulations, public should be informed about the incident in an appropriate manner. When was the last emergency exercise for transport? – An emergency exercise related to transport have not been practiced in the country. The last emergency exercise occurred in 2012. Have you exercised the response plan? - Development of the new response plan is ongoing.

7 - Compliance assurance and enforcement SSR-6 requires the competent authority to assure compliance with the regulations (para. 307) and GSR Part 1 requires the establishment of an enforcement policy in cases of non-compliance (Req. 31). For your country, who is responsible for: Verification of compliance of packages: Documentation, Labelling, Doses – The ministry of Environment and Natural Resources Protection.

Compliance for carriers - is defined by license conditions d. Notification: How do you know if an incident has occurred? - License holder should immediately notify the Ministry of Environment and Natural Resources Protection.
