Request Special Exception to allow office with warehouse units in the General Commercial (COM-2) Zoning District Special exceptions are land uses which are not similar in nature to the uses permitted in the zoning district, but which are desired in the community with appropriate controls when a suitable location is available.

Special Exception Request Evaluation Inconsistent with purpose and intent of City land development regulations? Inconsistent with the Comprehensive Plan? Adversely affect public interest? Requirements applicable for specific request? Compliance with Federal, State, local, or Board imposed conditions? Generates undue traffic congestion? Creates a hazard or public nuisance? Materially alter the character of the surrounding area? Adversely affect environment, including pollution?

Recommendation PLDRB Approve SE-OTH-08-02 subject to the following: The office/warehouse units shall not accommodate any uses not specifically permitted by right in the COM-2 District; 2. No outside storage of any type permitted outside of the units; and 3. The Special Exception is granted for a maximum of 2 years during which the applicant may pursue construction of the approved use. If construction has not begun within the 2 year time period the applicant may apply for a 1 time extension upon the showing of good-faith reliance. Such extension shall not exceed 12 months and is subject to approval by the Community Development Director. If construction has not begun by the end of the extended period, the applicant must reapply for a Special Exception.
