9 Community Development Department ENVIRONMENTAL/CULTURAL RESOURCES ANALYSIS Due to the developed condition of the property: –There is no impact on local topography. –No impact on natural vegetative community. –Low likelihood of permanent inhabitance by protected species. –No adverse impacts to environmental sensitive lands. The property lies outside the 100-year floodplain or special flood hazard area. The nearest well is greater than 1.0 mile from the location of the FLUM amendments. Activities associated with the proposed FLUM change will not impact the potable water supply. No impacts will occur to any historical or archeological resources, due to developed condition of property.

10 Community Development Department CONSISTENCY WITH COMPREHENSIVE PLAN POLICIES Policy 1.1.1.1 (D) - Industrial – This FLUM designation identifies areas suitable for both heavy and light industrial uses … Commercial and institutional uses are also allowed in this FLUM designation mainly to provide support facilities for large employment centers..

11 Community Development Department CONSISTENCY WITH COMPREHENSIVE PLAN POLICIES Policy 1.4.2.1 -The City shall provide an appropriate balance of commercial, retail, office, and industrial land uses on the FLUM to balance jobs and housing. Policy 2.1.8.3 – To encourage the use of the City’s inter-modal resources, the City shall encourage, through land use designations and other methods industrial development within the areas of the City that are adjacent to the Airport property and along the Florida East Coast Rail Line.

12 Community Development Department LAND DEVELOPMENT CODE ANALYSIS 1.Whether it is consistent with all adopted elements of the Comprehensive Plan. Staff Finding: The proposed rezoning from Flagler County Industrial to High Intensity Commercial (COM-3) for RZ-OTH-08- 01, and the proposed rezoning from Industrial to Industrial (IND- 1) for RZ-OTH-08-02 is consistent with the Comprehensive Plan Future Land Use Element designation of Mixed Use. 2.Its impact upon the environment or natural resources. Staff Finding: The properties contain existing and established businesses. No additional impact upon the environment or natural resources are expected to occur.

13 Community Development Department LAND DEVELOPMENT CODE ANALYSIS 3.Its impact on the economy of any affected area. Staff Finding: This proposed rezoning should have a generally positive impact on the Palm Coast community by allowing an established business to remain in the immediate area. 4.Notwithstanding any provisions of the land development regulations, its impact upon necessary governmental services such as schools, sewage disposal, potable water, drainage, fire and police protection, solid waste or transportation systems. Staff Finding: Minimal additional impact.

14 Community Development Department LAND DEVELOPMENT CODE ANALYSIS 5.Any changes in circumstances or conditions affecting the area. Staff Finding: Voluntary annexation of the site on March 6, 2007 into the City limits results in a changed circumstance requiring the City to designate the parcel in accordance to the City’s land development criteria. 6.Any mistakes in the original classification. Staff Finding: There were no mistakes made in the original classification.

15 Community Development Department LAND DEVELOPMENT CODE ANALYSIS 7.Its effect upon the use or value of the affected area. Staff Finding: The proposed rezonings will have a positive effect on the value of the affected area by allowing the City to continue to pursue voluntary annexations in the surrounding area. 8.Its impact upon the public health, welfare, safety, or morals. Staff Finding: Staff did not identify any negative impacts on the public health, welfare, safety or morals of the community.

16 Community Development Department FINDINGS The proposed FLUM amendment and rezoning is consistent with the Goals, Objectives, and Policies of the adopted Comprehensive Plan. The proposed rezoning is consistent with the 8 criteria established in the Land Development Code for a zoning change.

17 Community Development Department RECOMMENDATIONS Staff recommends approval of: FLUM amendment application # LU-MIN- 07-03a from County designation Industrial to City designation Industrial. Rezoning application # RZ-OTH-08-02 from County designation of Industrial to City designation of Industrial (IND-1).
