Presidential Succession 2.25 th Amendment a.Vice-president assumes the office of president in the case of a vacancy 1)9 VPs have succeeded to presidency (8 deaths and 1 forced to resign) b.If there is a vacancy for the Position of VP – the President appoints a new vice-president and the House and Senate confirm the appointment Gerald Ford was the first V-P appointed using the 25 th Amenment and the first appointed V-P to become President

Presidential Succession 3.Section 3 of the 25 th Amendment outlines how to determine if a President is incapacitated a.If the President is disabled or not able to perform his duties: 1)President must inform Congress in writing that the VP will be “Acting President” for a short time 2)Vice President and majority of cabinet member also notify Congress in writing that the President is so disabled. 3)President may resume power by informing Congress that no inability exists a)Reagan did this while having surgery and George H.W. Bush was acting President for 7 hours and 54 minutes George H. W. Bush was the first V-P to serve as “acting president” in 1985.
