Hazardous Waste and Soil Disposal The National Environmental Protection (Movement of Controlled Waste between States and Territories) Measure 1998 (NEPM) provides a national framework for developing and integrating state and territory systems for managing the movement of trackable (controlled) wastes between states and territories. The NEPM is implemented under the Queensland Environmental Protection Act 1994 through of the Environmental Protection Regulation 2008.

Hazardous Waste in Queensland Hazardous waste is managed as regulated waste in QLD Regulated wastes require waste tracking certificates Throughout the country regulated waste can also be referred to: Trackable waste Controlled waste Prescribed waste Transporter and disposal/treatment facility must be licenced

Contaminated Soil in QLD Contaminated soil is not regulated waste but depends on contaminant and site specifics / regulator advice Permit system in place – different requirements to waste tracking (requires prior approval) Sites need to be listed on the EMR/CLR Inconsistently applied: Permit only Waste tracking only Both permit and waste tracking

Why Track Waste? Enable regulatory agencies to track waste from its source to the place of storage, recycling, treatment or disposal. To ensure compliance with site specific licences. How is Waste Tracked? By implementing a three part system that records information from all parties involved in the process. It records information about the waste at the collection stage, the transportation stage and the disposal stage.

Waste Transport Certificate

Transport of Trackable Waste Between States (Interstate) Each state has a different system The waste must be properly classified Interstate transport of contaminated soil requires tracking and an interstate soil disposal permit You must have a Consignment Authorization Number (CAN) prior to transport When transporting into QLD, EHP issues CAN for the load When transporting out of QLD different processes apply

… You must complete a Waste Transport Certificate from the state the waste was generated in QLD EHP issues both intrastate and interstate WTCs Follow Australian Dangerous Goods Code if the waste is also a Dangerous Good You must keep records of all of the above

We need to comply with environmental laws regarding the transporting and tracking of controlled waste. There are Fines for Non- Compliance Penalties The Regulation allows for penalties of up to 20 penalty units 1 to be imposed if waste tracking information is not recorded, retained or provided to the department as required or if trackable waste is given to an unauthorised transporter. Penalties can be imposed through on-the-spot fines or may result in prosecution. There are also significant penalties of up to 1665 penalty units under the Environmental Protection Act 1994 for providing false or misleading documents to the department and for transporting a regulated waste without the appropriate authority. …

Waste Transporter Responsibilities Obtain from the generator the prescribed information about the waste. Give the prescribed information about the waste to the waste receiver. Report any discrepancies in information within seven days of becoming aware of the discrepancy to the department by written notice. Keep records of the prescribed information for at least five years. Interstate - only transport trackable waste when a consignment number has been issued.

Waste Receiver Responsibilities Record the prescribed information about the waste. Give the prescribed information about the waste to the department on a fully completed waste transport certificate. Report any discrepancies in information within seven days of becoming aware of the discrepancy to the department by written notice. Keep records of the prescribed information for at least five years
