2 Overview Participants of this course will be introduced to the various rules governing the completion and distribution for notices and manifests when conducting import of hazardous waste into Canada. 3. Overview Read the overview to the class.

3 Federal Legislation & Regulations
Canadian Environmental Protection Act (CEPA) Export and Import of Hazardous Waste & Hazardous Recyclable Materials Regulations Promulgated June 1, 2005 Coming into force – Nov 1, 2005 In Canada, federal regulations are administered by Environment Canada through CEPA, and the Ministry of Environment provides an added level of regulations through the EPA (Environmental Protection Act) to enforce environmental safety during management of waste during storage treatment and transportation.

4 Ontario Legislation & Regulations
Environmental Protection Act: Ontario Regulation 347 (Waste Management) Read the points listed. Tell them - These regulations currently enforced through the MOE, formerly the MOEE. Current minister is- Honorable Norm Sterling.

5 Manifest Completion and Distribution
The manifest system is used to track the movement of wastes in Ontario. Generators, Carriers, and Receivers all have certain obligations with respect to manifest completion and distribution. Manifest is a 6 page carbon copied document. (pg. 9 – manual) Turn to page 9 in the manual.

7 Manifest Distribution - Receivers
Receiver must obtain FOUR (4) copies of the manifest and distribute: Copy 3 to MOE within THREE (3) working days; Copy 4 to carrier; Copy 5 retain to TWO (2) years; Copy 6 to generator within THREE (3) working days. Brief review; MOE has issued notices of violations in the past for non-compliance with 3 day rule. As a result we implemented tracking systems to correct this deficiency.

8 Shipment into Ontario Each generator must be registered with Ontario MOE. (pg. 7 - manual) Each carrier who brings waste into Ontario must ensure that within 3 days of the out of province transfer; Copy 1 of the manifest is provided to the MOE. See pg. 7 of manual.

9 Compliance Issues – Ontario MOE
Missing / Illegible or inappropriate Waste Class Codes. Incomplete portions of manifest. Missing signatures.

10 Environment Canada The Export and Import of Hazardous Wastes Regulations controls international movement of Hazardous waste. (pg. 12 – manual) Utilizes Notice/Approval and manifest to control movement. Multiple waste streams can be listed on a notice. Pg 12 of manual

11 Environment Canada The manifest rules for Environment Canada have been modified to include: 3 working days for delivery of manifests Section A; Box 11 through 19 must be completed that provides the notice number and related IWIC information.

14 New/Modified Waste Streams
F,K, P & U codes, 89 TCLP constituents, Persistent Organic Pollutants Biomedical waste defn. expanded Schedule 8 added to identify exempted waste, Used oil and oil filters are now regulated by defn. Schedule 5 – 179 Env. Haz substances based on concentration by mass (100 mg/kg) Identified fully in Regulations see Web Site information.

15 Instructions (Canadian Importer)
   Provide the foreign generator with a copy of the notice form and approval letters. Provide the foreign generator with a brochure on hazardous waste exports to Canada. Support and assist the foreign generator in manifest completion.

16 Instructions - Foreign Generator
Ensure that waste identified on the manifest is listed in the notice. Ensure that there is sufficient volume on notice to accommodate shipment. Ensure that the transporter is identified on the notice. Ensure that carrier is aware of proper border crossings.

17 Instructions - Foreign Generator
Immediately before departure, fax the copy 1 of the Canadian manifest(s) to importing facility. Provide the transporter with Canadian shipping document (Copy 1 & Copies 3,4,5,6) notice & other shipping documents.

Provide the transporter with a duplicate (photocopy) package of shipping documents for Canada Customs: Photocopy of Canadian manifest Photocopy of Canadian Approval Letter and Notice

20 Rejections All rejections must be approved by EC.
A separate notice must be created for returns or rejections crossing international boundaries. Waste being re-routed to a destination other than as indicated on notice requires EC correspondence.

21 Actions – Nov 1, 2005 Remove old manifests out of circulation.
Ensure that old manifests are not used after Nov 1, 2005

22 Actions Continued Ensure that new manifest is used.
Ensure that new analysis requirements are met prior to shipment.
