3 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Transposition Directive 87/217/EEC has been mainly transposed into the national legislation through provisions of the Law Waste Management (OJ MNE 64/11 ), and secondary legislation: Rulebook on method packing and remove waste containing asbestos - being published in the Official Gazette of Montenegro.

4 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Competent Authorities Ministry of Sustainable Development and Tourism is competent for drafting the legislation in this area and has general competence for supervision over implementation of this legislation Also, supervision over implementation shall be performed by the competent authorities of local government Environmental Protection Agency is competent for keeping records on waste, keeping a register of collectors, dealers and intermediaries, permitting the processing and/or disposal of these wastes, maintain a register of data on emerging and waste management of asbestos based on data from the annual reports on waste and issued permits Inspection supervision for all types of waste, except for municipal and construction waste, shall be performed by the Environmental Inspectorate Inspection supervision of municipal and construction waste performs municipal Inspector

5 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation – inspection and enforcement system In addition to the powers set out by the Law on Inspection Supervision, the environmental inspector has the authority to: 1.check whether the waste is managed by the holder of the waste in accordance with this Law, plans and programs for waste management and requirements for environmental protection and public health 2.check whether the waste is collected separately 3.verify the fulfillment of conditions on the allowed mixing of hazardous waste 4.follow that the removal of waste is done at the location which is specified under spatial planning regulations, as well as in plants or facilities that meet the conditions set forth under special regulations 5.checks whether the waste management procedures are performed in accordance with the issued permits and approvals 6.monitor and control the transboundary movement of wastes

6 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation – inspection and enforcement system A fine in the amount of 500 - 20,000 Euros, shall be imposed on a legal entity, if: 1.performing the collection and transportation of waste, and is not entered in the register of collectors and transporters of waste 2.processing of asbestos cement construction waste 3.does not apply measures to prevent emissions of asbestos fibers and dust into the environment

7 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Proper administrative set-up for building capacity for reporting to the Commission: - on methods of sampling and analysis - on implementation of the Directive There is a need for additional staff and trainings, in order to comply with Directive requirements Administrative capacity
