Resolving Labor Differences Different Methods/Approaches to Ending Disputes Between Workers and Owners

Mediation A neutral 3rd party listens to both sides and proposes a recommended solution Recommendation does not have to be accepted by either side

Mediation Pros Cons Unbiased person is helping to solve the problem If one side doesn’t like the recommendation, they aren’t forced to accept it May not solve the problem if the recommendation is not accepted by both sides

Arbitration Neutral 3rd party listens to both sides’ arguments Creates a solution Both sides MUST accept the solution

Arbitration Pros Cons Unbiased person is helping solve the problem Guaranteed to end the dispute One or both sides may not like the final decision, but must accept it

Fact-Finding Neutral third party collects facts about the dispute (rather than listening to arguments) and presents nonbinding recommendations Neither side has to accept the recommendation

Fact-Finding Pros Cons Unbiased person is helping solve the problem Neither side is forced to accept the final decision if they don’t like it Removes lies and exaggerations from the dispute Doesn't solve the problem if both sides to accept the solution Some facts may be left out or impossible to determine

Quick Review Which two of the resolution methods does NOT require both sides to accept the recommendation made by the 3rd party? Which resolution method DOES require both sides to accept the recommendation? Mediation & Fact finding Arbitration
