Settling Conflicts Self-Help Remedies –Negotiating – finding a solution that is acceptable to both sides –Withholding Payment – stop payment on credit purchases until dispute is resolved

Settling Conflicts Small-Claims Court –Matter is heard quickly –you represent yourself –decision is final – maximum of $2,000 to $5,000 –judge decides –Example - Judge Judy & People’s Court

Settling Conflicts Class Action Lawsuits –Large number of people w/ similar complaints join together to sue –Usually involves products that injured many people –If the plaintiff wins, they all split the judgment

Settling Conflicts Alternate Dispute Resolution –The use of several methods of resolution without using the court system –Negotiations, mediation, arbitration

Alternate Dispute Resolution Mediation –An independent third person helps the parties come to their own solution+ –Mediators have no power to impose a settlement Voluntary Arbitration –Listens to both sides and makes a recommendation but cannot impose it Binding Arbitration –Listens to both sides and makes a decision that both parties must accept
