2 Settling Conflicts Self-Help Remedies –Negotiating – finding a solution that is acceptable to both sides –Withholding Payment – stop payment on credit purchases until dispute is resolved

3 Settling Conflicts Small-Claims Court –Matter is heard quickly –you represent yourself –decision is final – maximum of $2,000 to $5,000 –judge decides –Example - Judge Judy & People’s Court

4 Settling Conflicts Class Action Lawsuits –Large number of people w/ similar complaints join together to sue –Usually involves products that injured many people –If the plaintiff wins, they all split the judgment

5 Settling Conflicts Alternate Dispute Resolution –The use of several methods of resolution without using the court system –Negotiations, mediation, arbitration

6 Alternate Dispute Resolution Mediation –An independent third person helps the parties come to their own solution+ –Mediators have no power to impose a settlement Voluntary Arbitration –Listens to both sides and makes a recommendation but cannot impose it Binding Arbitration –Listens to both sides and makes a decision that both parties must accept
