Marbury v. Madison

The Judicial Branch What is it? How is it structured? Basically, the U.S. Court System How is it structured?

The Supreme Court What is the Constitution? Document that says how our government works. Says what the government CAN and CANNOT do What is the job of a court? To determine whether someone broke the law or not and what the punishment should be What is the job of the Supreme Court? To determine whether or not a Law that Congress has created, is ALLOWED to be a law according to the Constitution This POWER is called, “JUDICIAL REVIEW”

Supreme Court Decisions - Example Before 1954, African American students could not attend the same schools as white students Supreme Court: Has to decide whether this is ALLOWED based on what the Constitution says Brown vs. Board of Education Schools must allow students of all races to go to school together If not, you are violating the Constitution because it says ALL people must be treated equally
