4 Powers of the Court Legislative & executive branch must follow Supreme Court rulings Main job to decide if laws are constitutional – allowed by the Constitution Judicial review – power to say whether any law or government action goes against the Constitution

5 Judicial Review Established in the case Marbury v. Madison President John Adams was leaving office, he made William Marbury justice of the peace Incoming President, Thomas Jefferson, refused to carry out the order. Marbury took the case to the Supreme Court

6 Court’s Opinion 3 principles of judicial review set forth by John Marshall 1.Constitution supreme law of the land 2.If a law conflicts with the Constitution, Constitution wins 3.Judicial branch has a duty to uphold the Constitution

7 Limits On Power Court depends on executive branch, state & local officials to enforce its decisions. Court cannot decide a law is unconstitutional unless the law has been challenged in a lower court & comes on appeal Congress can get around a ruling by: –Passing a new law –Changing a law ruled unconstitutional –Amending the Constitution
