Religion: Congress may not set up an official church or forbid the practice of religion or enforce the practice of religion Speech: Congress may not limit the freedom to speak or write freely. Press: Congress may also not censor what gets published. Assembly: Right to hold public meetings Petition: The people have the right to ask the gov’t for wrongs to be corrected

4 Third Amendment Quartering of Troops Pg 114
During times of peace, soldiers may not stay in private homes without the owners’ permission

5 Forth Amendment Searches and Seizures Pg 115
Private residences may only be search and property seized (taken) if a judge has issued a warrant (written court order) Warrants are only issued if there is probable cause, meaning a search will most likely produce evidence of a crime

Pg 115 Fifth Amendment Criminal Proceedings; Due Process; Eminent Domain A person on trial cannot be forced to give evidence or testify against themselves. A person cannot be tried twice for the same crime-known as double jeopardy. Gov’t cannot seize any private property for public use w/o paying the owner a fair price for it

A person accused of a crime has the right to a speedy, public trial by an impartial jury The person has the right to know what they are accused of The accused has the right to question all testimony, witnesses and evidence against him/her The person has a right to a lawyer

Right to a jury trial in lawsuits where the sum of money at stake is more than $20 An appeals court can set aside a verdict only if legal errors made the trial unfair

9 Eighth Amendment Punishment for Crimes Pg 116
Prevents the court from imposing bail or fines that are too excessive or too high Forbids cruel and unusual punishments, such as physical torture

10 Ninth Amendment Unenumerated Rights Pg 116
The rights of the people are not limited to the Bill of Rights

11 Tenth Amendment Powers Reserved to the States Pg 116
Any powers not given to the federal gov’t belong to the states
