16 11.1 Powers of the President  Powers in Constitution  Vesting clause - Article II of the Constitution begins: “The executive Power shall be vested in a President of the United States of America.” Run executive branch Report to Congress on State of the Union

17 Make Appointments – federal judges, Cabinet members, ambassadors, generals. Appointment power - federal judges, ambassadors, and other executive branch officials, subject to confirmation by the Senate. Recess appointments - To get around Senate inaction on nominees, or Senate refusal to confirm them, presidents have resorted to making recess appointments—appointments made when Congress is not in session to vote on the nominee. The constitutionality of recess appointments is controversial but it is easy to see why presidents use them. Remove Appointments – except judges Presidential Power (Executive Powers)

18 Presidential Power (Diplomatic / Military Powers) Negotiate Treaties – The president can negotiate treaties, but Congress must ratify them (2/3 of Senate). Executive Agreements – pact requiring no formal consent from the Senate. Recognition – acknowledgement of the legal existence of a nation or its govt.

19 Presidential Power (Diplomatic / Military Powers) Commander in Chief – The president can deploy troops, authorize a military strike, w/o Congressional approval for up to 90 days. Congress officially declares war (Declaring war versus waging war) Congress can fund, or defund the mission. War Powers Resolution (1973) (Reassertion of Congressional authority) –President must inform Congress of any military engagement within 48 hours. –Must end operation after 60 days without Congressional approval

20 Presidential Power (Legislative Powers) Recommend Legislation Veto Bills - The president can veto legislation passed by Congress, but Congress can override his veto by two-thirds vote in both houses. Often the mere threat of a veto is enough to get Congress to revise a bill before it crosses the president’s desk. Pocket veto - If a president neither signs nor vetoes a bill in ten days, it becomes law. A pocket veto occurs when a president does not sign a bill for ten days but Congress adjourns during that time. Line-Item Veto - A line item veto would have given the president authority to strike individual provisions from bills he signed but the Supreme Court declared this power unconstitutional in 1998.

22 The President’s veto authority is among his most significant tools in legislative dealings with Congress. It is effective not only in preventing the passage of legislation undesirable to the President, but also as a threat, sometimes forcing Congress to modify legislation before it is presented to the President. Students of executive-legislative relations suggest that Congress’s strength rests with passing statutes and the President’s in vetoing them. 25 Presidential Power (Judicial Powers) Grant Pardons – Presidents have the power to pardon, or grant legal forgiveness for a crime in federal cases, individuals accused or convicted of federal crimes. President Ford angered many Americans when he pardoned Nixon after his resignation. Grant Amnesty – a blanket pardon offered to a group of law offenders Grant Commutation – reducing the length of a sentence or fine imposed. Grant Reprieves – postponement of a sentence in federal cases.
