1. What year was the first law adopted regarding special education? 1954 1975 2004

Think about this … In 1954, the U.S. Supreme Court ruled on the Brown vs. Board of Education extending equal protection to minorities paving the way for those students with disabilities. In 2004, President George W. Bush signed into Congress H.R. 1350, The Individuals with Disabilities Improvement Act (IDEA 2004), which included modifications in the IEP process and procedural safeguards, increased authority for school personnel in special education placement decisions, and alignment of IDEA with the No Child Left Behind Act of 2001. In 1975, Congress passed Public Law 94-142 which proved to be landmark legislation, requiring public schools to provide students with a broad range of disabilities - including physical handicaps, mental retardation, speech, vision and language problems, emotional and behavioral problems, and other learning disorders – with a "free appropriate public education." Moreover, it called for school districts to provide such schooling in the "least restrictive environment" possible. Next

Think about this … The Equal Opportunities Act of 1974 provides that no state shall deny equal educational opportunity to an individual on the basis of race, color, sex, or national origin. The Massachusetts Law of 1647 decreed that every town of at least 50 families hire a schoolmaster who would teach the town's children to read and write and that all towns of at least 100 families should have a Latin grammar school master who will prepare students to attend Harvard College. Excellent! These laws and legislation govern special education. Since the first special education law was passed in 1975, legislation has contained core principles to ensure the educational rights of students with disabilities and their parents including zero reject, free appropriate public education, least restrictive environment, non-discriminatory evaluation, parent and family rights and procedural safeguards. The Rehabilitation Act of 1973 protects the civil rights of ALL individuals with disabilities. The Americans with Disabilities Act of 1990 applies to both public and private sectors, including libraries, state and local governments, restaurants, hotels, theaters, transportation systems and stores. 3. Who receives Special Education? Every child is entitled to receive Special Education services. Only students who have severe disabilities. Any student that qualifies under one of thirteen specific categories identified under IDEA.

Think about this … Every child is entitled to a public education and the services provided under public education but only certain individuals are entitled to receive “special education” services. Return

Think about this … An IEP is a program developed by the student’s team for the individual specially to meet the needs of the student. It is neither a play nor a procedure but can be based on the student’s experiences. Return

An IEP is an individualized education program that encapsulates all of the decisions made through the special education assessment, eligibility, and instructional planning procedures. Think about this … It is not the sole responsibility of the special education teacher to be a member of the IEP team nor is it the responsibility of the special education teacher and parents alone. All professionals, the parents and the students have a responsibility to be a part of the IEP team and be active participants. Return
