Supplement vs. Supplant Neither Title I nor Title III funds may be used to administer ELP assessments for identification and placement purposes (e.g. Title III funds may not be used to pay for substitutes for administering Woodcock Munoz). Title I and Title III funds may not be used to administer State ELP assessments (WESTELL) because use of Title III funds for this purpose would violate the supplement not supplant requirements (e.g. Title III funds may not be used to pay for substitutes for WESTELL administration). Title III funds may not be used to provide core language instruction educational programs, including providing for the salaries of teachers who provide those core services for LEP students (e.g. Title III funds may not be used to pay the salaries of ESL teachers). 3

Maintenance of Effort Legal Requirements -Section 9521(a) of the ESEA states that a Local Education Agency (LEA) may receive funds under a covered program for any fiscal year only if the State educational agency (SEA) finds that either the combined fiscal effort per student or the aggregate expenditures of the agency and the State with respect to the provision of free public education by the agency for the preceding fiscal year was not less than 90 percent of the combined fiscal effort or aggregate expenditures for the second preceding fiscal year. The calculations for this process is exactly the same as Title I, however it must also be addressed in the Title III application. Counties will calculate one time. The Title III director must submit/confirm this Maintenance of Effort and it will be reviewed/approved as part of the Title III plan. 4
