Inspecting safeguarding in post-16 education and training Natspec Conference October 2012

Safeguarding now woven through the CIF Outcomes for learners:  learners develop personal, social, and employability skills Teaching, learning and assessment:  learners benefit from staff’s high expectations, engagement, care, support and motivation from staff Leadership and management  ensure the safeguarding of all learners.

Where relevant, inspectors should take into account:  whether providers have a single, central record of all checks on staff and volunteers where appropriate  the provider’s compliance with its statutory duty to assist local children’s services departments on child protection matters and, as appropriate, to liaise with the Local Safeguarding Children Board  whether the provider takes appropriate action when a learner reports concerns  whether there is a designated senior member of staff in charge of safeguarding arrangements who has been trained to the appropriate level

Where relevant, inspectors should take into account:  whether the provider has contact details for a parent, carer or person acting in loco parentis for learners aged up to 18 (and up to age 25 for learners with learning difficulties and/or disabilities)  whether policies on bullying and discrimination are implemented effectively  the extent to which all learning and development sites provide a safe learning environment, and safe working practices are promoted in training and at work  whether thorough risk assessment and checks on staff across the provision provide the basis for a provider’s safeguarding policy and plans.

No longer a limiting grade but will still report on whether or not you are meeting statutory requirements – which will impact on Leadership & Management Inspection of safeguarding will focus on how you assess risks to learners and what action you take to reduce or control them.

Changes in legislation (1) Protection of Freedoms Act 2012 from September 2012:  2010 ISA ‘offences’ in SVGA remain but nothing else  Controlled Activity abolished  Reduced scope of ‘Regulated Activity’ – effectively removes many people from CRB requirements including volunteers

Changes in legislation (2) Protection of Freedoms Act 2012 from September 2012:  Concept of ‘supervision’ for volunteers  Reduced definition of ‘Vulnerable Adults’ – mainly focused now on staff providing health or personal care  CRB and ISA will merge to become DBS – to host barred lists and make barring decisions

Changes in legislation (3) Protection of Freedoms Act 2012 from April 2013:  Introduction of on-line CRB update service  Will require one-off fresh certificate and annual registration (nominal fee)  Continual updates (free checking) but with ‘flags’ only, to prompt need for fresh CRB certificate  Mainly of interest to those who move between jobs regularly - portability and no ‘3 month gap’

Forward look:  Revised version of ‘SCSRE’ being developed  Possibility of removing compulsion in CRB checks  completely
