3 How the Legislation Affects You
The Disclosure and Barring Service now serves the functions previously undertaken by the Criminal Records Bureau (CRB) and the Independent Safeguarding Authority How the Legislation Affects You

4 What is the DBS check? And….
It is a criminal records check plus a check made against the barred lists There are two lists: one which lists those barred from working with children and a separate list of those barred from working with vulnerable adults. A person may be checked against either or both of these lists, depending on their role Working Together is out A DBS check is for those working in Regulated Activity with children or vulnerable adults

5 Regulated Activity in our sector
1. Unsupervised activities: teaching, training, instructing, caring for or supervising children, or providing advice / guidance on well-being, or driving a vehicle only for children 2. Work for a limited range of establishments (specified places), with opportunity for contact, for example schools, children's homes, childcare premises (but not work by supervised volunteers)

6 Frequency Activity is only defined as Regulated if done regularly
In this context, regular means carried out by the same person frequently (once a week or more often), or on 4 or more days in a 30-day period (or in some cases, overnight)

7 Supervision A reasonable level of supervision is defined as: regular
day to day reasonable in all the circumstances for the purpose of protecting the children concerned carried out by someone who is in regulated activity.

8 Not Regulated Activity
If staff or volunteers work under a reasonable level of supervision If work in specified places consists of occasional or temporary services, e.g. maintenance (not teaching etc.) If it doesn’t meet the frequency test

9 Costs, Checks and Timescales

12 DBS coming soon… improved digital environment
Apply online for DBS checks through a new web portal which will be simple to use. Barring referrals will be made online and people who have been referred will also be able to check on the progress of their case or make representations through the web. For our police partners we will centralise our interactions into one system and provide information in a timely, quality driven, digital environment.
