EMSA “Info Day” in Montenegro: EMSA, in collaboration with MSD, on 17 September 2009 organized ‘Info Day’ on the work of this agency and its significance for the implementation of EU legislation in national legislations. Presentation was attended by the representatives of the many institutions and legal subjects: Ministry of Transportation, Maritime Affairs and Telecommunications Harbour Master’s Offices (Bar and Kotor) Environmental Protection Agency, Department of Police – Border police division, Ports and marinas Shipping companies and agencies Training institutions in maritime sector Maritime Safety Department of Montenegro

Cooperation between EMSA and MSD Knowledge acquired on training is used in preparation of Draft Law and By Law acts: Draft Law on the Prevention of sea pollution from sea-going vessels Draft Law on the Maritime safety and security Many other By Law Acts Maritime Safety Department of Montenegro

Draft Law on the Prevention of sea pollution from sea-going vessels is currently being drawn up and is in accordance with EU community law and international conventions: EU DIRECTIVE 2002/59 Establishing a Community VTMIS EU DIRECTIVE 2000/59 Port reception facilities for ship-generated waste and cargo residues EU DIRECTIVE 2005/33 on sulphur content of marine fuels REGULATION (EC) 782/2003 on the prohibition of organotin compounds on ships (AFS 2001 Convention) PROVISIONS OF THE OPRC CONVENTION 1990, OPRC-HNS PROTOCOL 2000 AND 2002, PROVISIONS OF PREVENTION AND EMERGENCY PROTOCOL TO THE BARCELONA CONVENCTION 1995 that are concerned with preparedness, response and co-operation in case of marine pollution, necessary for preparation of National Plan for Emergency Response. PROVISIONS OF THE CLC CONVENCTION 1992, FUND CONVENCTION 1992, HNS CONVENCTION 1996, BUNKERS CONVENCTION that are concerned with liability and compensation for pollution damage caused by oil pollution. Draft Law on the Maritime safety and security is currently being drawn up and will bring some changes on Montenegro maritime organisation: Maritime Safety Department of Montenegro 1.Registration of boats, vessels and other navigable objects will pass from Harbour master officies to Maritime safety department 2.Marine survey division of Maritime Safety Department will pass to Flag state inspection division 3.According to IMO res.A.739(18), IMO res.A.789(19) and EU Directive 94/57/EC Government of Montenegro will authorized classification society (IACS members) as Recognised Organization for statutary survey. 4.Harbour master officies will performs activities regarding: a) Port state control inspection and improve it to the level of PARIS MoU b) Seafarers examinations, on which base certificates will be issued.

Coordination on implementation of new technical requirements in field of maritime safety and security: Implementation LRIT (Long Range Identification and Tracking) in Montenegro. In coordination with EMSA, Montenegro sent the application to EC to participate on EU LRIT Data Centre. Montenegro is completing AIS (Automatic Identification System for ships) network. Design of network was done using valuable information of EMSA “Expert Working Groups”, using their material published on EMSA web site. Design has also take in the consideration technical requirements for future participation of Montenegro in regional AIS system STIRES. Maritime Safety Department of Montenegro

Proposal on EMSA training activities during 2010 that will bee useful for Montenegro maritime administration 1. Training for newcomers on EU maritime legislation 2.Training on implementation of vessel traffic management information system VTMIS 3.Training on ism and ISPS code. 4.Training and promoting best practices on directive 99/35/EC (ROPAX). 5.Training on human element in maritime safety. 6.Training for marine accident investigators. 7.Training on environmental issues (contingency plan). Proposal for other Pre-Accession Assistance for maritime sector of Montenegro 1.
