5 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14: TRANSPORT POLICY Chapter 14: Transport policy MINISTRY OF TRANSPORT AND MARITIME AFFAIRS DECREE ON ORGANIZATION AND METHOD OF OPERATION OF STATE ADMINISTRATION (OFF. GAZ. OF MNE 05/12, 25/12, 61/12, 20/13) STIPULATES THAT MINISTRY OF TRANSPORT AND MARITIME AFFAIRS SHALL PERFORM AUTHORITY FUNCTIONS, WHICH INTER ALIA REFFER TO: SECURITY PROTECTION OF MERCHANT SHIPS AND PORTS OPEN FOR INTERNATIONAL TRANSPORT ( in accordance with ISPS CODE and Chapter XI-2 of SOLAS 74 Convention)

6 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14: TRANSPORT POLICY Chapter 14: Transport policy LEGAL FRAMEWORK 1.Ratification of SOLAS 74 Convention (Chapter XI-2 and ISPS Code) 2.Regulation on security of merchant ships and ports open for international traffic (OFF. GAZ. OF SCG 32/04) 3.Decree on Organization and Method of Work of the State Administration (Official Gazette of Montenegro 05/12,25/12, 61/12, 20/13) stipulates that the Ministry of Transport and Maritime Affairs shall perform authority functions, which inter alia refer to: security protection of merchant ships and ports for international transport

9 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14: TRANSPORT POLICY Chapter 14: Transport policy CURRENT SITUATION IMO INSTRUMENT EU LegislationNational legislation (Montenegrin ports) National legislation (Flag State) Poglavlje XI-2 SOLAS 74 Convention ISPS Code Regulation(EC) No. 725/2004 Regulation on security of merchant ships and ports open for international traffic (OFF. GAZ. OF SCG 32/04) fully apply PART A of ISPS Code Agreement which regulates the transfer of authorization for the provision of services of survey and mandatory certification for navigable objects registered in Montenegro fully authorized RO to apply Part A of ISPS Code on vessels engaged on international voyages. Amended by Comm. Decision 2009/83/EC Companies managing ships flying Montenegrin flag have been indentified by IMO number. Mandatory requirement of using IMO numbers for Companies will be part of New Law on Security of Navigation

10 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14: TRANSPORT POLICY Chapter 14: Transport policy IMO INSTRUMENT EU LegislationNational legislation (Montenegrin ports) National legislation (Flag State) Directive 2005/65/EC No special security requirements for Port open for international voyages other than those mentioned in Part A of ISPS Code. Comm. Regulation (EC) No. 324/2008 Comm. Recommendation of 11 March 2010 No specific security requirements related to the application of BMP on vessels flying Montenegrin flag. There is a possibility given by the Ministry of transport and Maritime Affairs to board an armed escord on vessel flying Montenegrin flag passing piracy area

11 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14: TRANSPORT POLICY Chapter 14: Transport policy IMO GISIS database SOLAS regulation XI-2/13 According to above mentioned requirement of SOLAS Convention, Ministry of transport and Maritime Affairs nominates: 1.Details of Contact Points for security related communication with the Organization (SOLAS regulation XI-2/13.1.1) 2.Details of Organizational Contact (SOLAS regulation XI-2/13.1.1,.1.3,.1.4,.1.5 and.2) a.National authorities responsible for ship security, b. Proper recipients of SSAS alerts, c. Proper recipients of requests for assistance with security Incidents 3.Details of port facilities (SOLAS regulation XI-2/13.3)
