6 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union INSTITUTIONAL FRAMEWORK Chapter 14: Transport policy Chapter 14: TRANSPORT POLICY  Ministry functions as national regulator on maritime safety, security and maritime environmental issues. Within its competence in the field of maritime transport has responsability on: proposing policy of maritime transport, proposing a national strategy for the development of maritime transport, representing Montenegro in international organizations, proposing and negotiating, under the authority of the Government of Montenegro, ensuring proper implementation of international agreements on maritime transport, adopting bylaws in accordance with Law and performing other activities in accordance with Law.  Harbour Masters Offices have responsibilities over Ship formalities, Port State Control inspections, ship registry and issue of licensing for seafarers.  Maritime Safety Department is state body depending from the Ministry on its legal performance. Main responsabilities are: safety of navigation in territorial sea and internal waters, search and rescue, maritime radio communication, aid to navigation, ship reporting system (ADRIREP), ship statutory inspections, yacht registry, yachts safety technical inspections and environmental protection in the maritime coastal and internal waters

7 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union LEGAL FRAMEWORK Chapter 14: Transport policy Chapter 14: TRANSPORT POLICY Law on Maritime and Inland Waters NavigationOfficial Gazette of RM, 12/98, 44/99, 74/99 and 73/00 Law on YachtsOfficial Gazette of the RM, 46/07 Law of the SeaOfficial Gazette of the RM, 46/07 Law on PortsOfficial Gazette, 51/08 Law on Protection of Sea Pollution from Sea-Going Vessels Draft Law on Safety of Maritime Navigation Official Gazette, Montenegro has no legal framework related to VTMIS. VTMIS is introduced in Draft Law on Safety of Maritime Navigation. Draft Law on Safety of Maritime Navigation will be approved during 2013 Montenegro participates in ADRIREP mandatory reporting in adriatic Sea for dangerous goods IMO Resolution MSC.139(76)

8 Chapter 14: Tansport M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14: TRANSPORT LEGAL FRAMEWORK - TRANSPOSITION Directive 2002/59/EC is transposed into the draft Law on safety of maritime navigation Chapter IV of draft Law defines following: Responsible bodies for impelemnting VTMIS are Maritime Safety Department and Harbour Master Officies – article 46; Notifications prior to entry to port and information requirments – article 47 and article 48; Requirments for Automatic identification systems (AIS), long-range identification and tracking of ships (LRIT), voyage data recorder (VDR), are defined in article 49, Fishing vessels should be equipemd with AIS, article 49. Information exchange in particular for ships posing a potential hazard is defined in article 47 "Places of refuge” are defined in article 35.

9 Chapter 14: Tansport M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14: TRANSPORT IMPLEMENTATION Current Activities Ongoing EU funded project IPA 2011: “Establishment of VTMIS and improvement of authority's response to marine pollution incident” Overall cost : 3.500.000 EUR EU contribution: 2.800.000 EUR National contribution (Ministry of Transport and Maritime Affairs): 700.000 EUR Maritime Safety Department is main beneficiary. Project Activities (from 2012 to 2014): VTMIS 1.1.Activity 1 - VTMIS equipment, contract signed and implementation started 3 sites on the coast + Control Centre Sensor equipment in each site: Solid State Radars, VHF, AIS, Direction Finders, meteo sensors, Radio Links, Towers, VTS software compatible with „SafeSeaNet” 1.2.Activity 2 – VTMIS training Response equipment 2.1Activity 3 - Procurement of equipment for emergency intervention at the sea Contract signed and implementation started. 2.2 Activity 4 - Training for pre-positioned equipment 2.3 Activity 5 - Assessment for Place of Refuge

10 Chapter 14: Tansport M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14: TRANSPORT IMPLEMENTATION Future Activities : Areas not covered by IPA 2011 project and proposed for financing with IPA 2 (2014-2020)- VTMIS phase II VTMIS project (phase II) will cover following topics: CCTV sensors on the existing sites and Port of Bar Skadarsko lake: VHF and Short range radar Boka Bay: Short range radars, CCTV and Traffic regulation plan Training for MSD & Harbour Master Offices staff on reading VDR data Study on National Single Window (NSW) with the aim of upgrading VTMIS project in order to optimize the process of vessel handling and fulfilling the requirements of EU Directive 2010/65/EC VTMIS software modification in order to be compatible with latest version of SafeSeaNet and EU directive 2010/65/EC

11 Chapter 14: Tansport M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14: TRANSPORT IMPLEMENTATION CHALENGES Providing national contribution for IPA 2011 project and completing planned activities, Providing EU funds for VTMIS phase II project during programing period for IPA 2 (2014-2020), Participation in SafeSeaNet Membership in EU LRIT Data Centre. Application sent on 2008. Criterias should met. Participation in CleanSeaNet service. Montenegro sent application to EC and EMSA at and of 2012. Montenegro participation on expert working groups related to SafeSeaNet, LRIT, AIS, CleanSeaNet etc. in order to be prepared on time for their implementation.
