Interregional Agency Founded by 3 regions (2013) – only government bodies, no private bodies/concessionaires (art 92 bis BWHI) Concessionaire (Sofico) will join the tender procedure for SSP via ‘samenvoegingsoverkomst’ – merger-agreement Interregional agency = penholder in tender procedure Possibility future concessionaires to join interregional agency is still ‘under study’ Interregional agency will be created in spirit of good governance (special majorities, veto-rights, etc…) Concessionaire (Sofico) can be represented in the board of governors via Walloon Region Agency will be staffed by civil servants

Sofico (Société de Financement Complémentaire des infrastructures) was created in 1994 by the government of the Walloon region and is a public corporation. Sofico’s objectives are twofold: -The financing, renovation and maintenance of the existing Walloon road network; -The completion of missing junctions in the existing Walloon road network which were identified by Europe. Sofico’s role in the road charge system: -Sofico will on the one hand be a contracting party in the DBFMO contract and on the other hand work together with the three regions in the interregional entity during the operational phase. -Sofico will both collect the user payments and disburse the availability payments which relate to its own road network. -Sofico will have no role in the road vignette system 2. Monitoring KPI’s: SSP sends rapport to interregional agency in 20 days after each month If expected KPI’s not respected -> SSP has to report in 24 hours SSP gives access to data in databases Interregional can perform audits in SSP (max. 20 days a year collaboration SSP, free of charge) 3. Each region autonomous for enforcement 3 legal frameworks: –Each region decides on type of infractions –Each region has its own REA and RASA –Controle-officers work only in their territory But cooperation agreement wil foresee in coordination and mutual exchange: for exemple: level of fines, REA’s can share same building, mutual legal cooperation to stop vehicles 4.
