Review of Title IX Educational Law (1972)  Requires educational institutions to maintain policies, practices and programs that do not discriminate against anyone based on sex. Schools are to treat both sexes equitably with regard to:  Effective accommodation of Athletic Interests and Ability  Athletic Financial Assistance for Student Athletes (Post- Secondary)  Equivalence in Other Athletic Benefits and Opportunities  This is the 3 prong test, educational institutions must meet one of the three but for high schools, only two prong apply.

Review of Act 82-Article XVI Phase I: School Data Collection  “A school entity will annually submit information to PDE by October 15 th of each year regarding Interscholastic Athletic Opportunities and treatment for male and female secondary students (7 th -12 th grades) for the preceding school year.”  Data Required  Disclosure Form Disclosure Form  Public Notice and Review  Deadline= November 1  PDE report to General Assembly  Deadline= January 15 th

Act 82-Article XVI Phrase II- Non-School Data Collection  All school entities will be required to collect and submit information concerning non-school contributions and purchases.  Non-School Entities include:  Booster clubs  Alumni  Any other individual or group  Non-School funds equate to benefits provided by the school, thus school’s responsibility to ensure equity.  Reporting Form  Example Example  Booster Club Form Booster Club Form
