4 Title IX and Athletics Three-Part TestHigh School Athletics Courts typically rely on the proportionality test to determine high school compliance. Not monitored as strictly as college athletics due to a lack of funding and systems to monitor 63% of student population is female, 63% of athletic population must be female Provide athletic participation opportunities that are substantially proportionate to student enrollment Surveys to determine athletic interest of underrepresented sex Demonstrate a continual expansion of athletic opportunities for the underrepresented sex Implementing new sports programs Accommodate the interest and ability of the underrepresented sex

5 Issues with Title IX Add Women’s Teams Cut Men’s Teams At the collegiate level male athletes per school declined 6% and men’s teams per school dropped 17% from 1981-2005. National Women’s Law Center filed administrative complaints against 12 school districts claiming they were not providing enough competitive opportunities. If the proportionality test is successfully applied to high school athletics, over 1.3 million male high school athletes could be sidelined.

6 CCSD Compliance Facilities/Equipment Student Interest and Opportunities Conducting surveys to measure athletic interest. Schools do not have to offer the same sports to males and females. Institutes must accommodate to the same degree the athletic interests and abilities of each sex in the selection of sports. Now offering Flag Football in the winter based upon student surveys. Equal facilities and equipment for male and female athletics Stadium lights and locker rooms are common compliance issues
