Sovereignty Many municipalities throughout Washington State enforce traffic violations via camera. Some Cities such as Puyallup include land adjacent to sovereign tribal lands. Tribes have laws prohibiting traffic violations on their sovereign lands. However, no tribes in Washington State are currently using camera based enforcement

Sovereignty Traffic cameras have been controversial because they have been seen as an invasion of privacy. In actuality, they are merely an extension of law enforcement officers. Enforceability is more stringent with cameras as it is with live officers. The data shows that camera based enforcement has direct positive impact on traffic safety and safe driving habits.

Sovereignty Use of the traffic cameras is a direct expression of Tribal sovereignty in the face of municipalities using the cameras It is an expression of sovereignty for a nation to maximize the safety of it’s roadways for it’s Tribal members and visitors. It is an expression of sovereignty for the Tribes to use all of the tools available to them to enforce their laws It is an expression of sovereignty to enforce compliance of Tribal legal codes that include toll use of roadways, inappropriate access to usual and accustomed Tribal resource areas, marine enforcement, and others.

Traffic Safety and Compliance Numerous studies in the Pacific Northwest show that public opinion increases dramatically based upon reduced fatalities, serious accidents, and an increase in safe driving. Studies also show that camera based traffic enforcement solves the root problem by changing dangerous driving habits.

Traffic Safety and Compliance Tribes historically have been leaders in environmental sustainability Tribes have the opportunity to become leaders in traffic safety Camera enforcement aligns directly with Washington State and the National Highway association initiative: Project Zero Project Zero has a target of zero traffic fatalities by The safety of Tribal members and visitors to Tribal land is certainly equal to the commitment of National, State, and municipal governments.

Distracted Driving A growing number of serious accidents and fatalities are now related to cell phone usage and texting while driving. Most states, counties, and cities have “Distracted Driving” ordinances that prohibit cell phone usage and texting while driving.

Distracted Driving Speeding and red light violations are easy to enforce via cameras. For cell phone usage and texting while driving, an image needs to be taken of the driver inside the vehicle and it needs to show clearly that the driver is using the cell phone or texting. This makes the burden of proof substantially higher than it is for speed and red light enforcement. To date a staff person has to review each image individually as 80% are not conclusive.

Traffic Safety and Compliance For Tribes, Brekford would work with the Tribal Council, Courts, Public Safety, Education, Economic Development, Employment, and any other related divisions of the Tribe to develop camera safety programs from the ground up to meet the Tribe’s specific needs.

Employment Brekford provides this support through centers created in the region where camera enforcement is developed. Although some traffic camera providers have national clearinghouses, Brekford’s philosophy is to engage and build the regional economy by developing centers locally and employing local workers.

Employment Jobs created would be meaningful and living wage. The Tribe would control all of the hiring. Jobs would include: – GIS Mapping for camera placement, ongoing review, and selection of new locations – Technicians to review images – Administrators to process citations and support billing and collection of fees – Customer service to provide information to the public (general and those cited for violations) – Technical support for hardware (computers and cameras) – Technical support for software and updates – Legal positions to review, revise, and develop traffic codes – Public safety evaluation of camera impacts on traffic safety – Overall system management

Brekford Strengths Brekford has direct experience working with sovereign government, including Colombia and Mexico internationally. Brekford is an industry leader in public and traffic safety and the only provider with the new “Distracted Driving” software.

Brekford Strengths Brekford requires no up-front money to pay for the cameras. Brekford only makes money when the Tribe generates revenue from the cameras. Brekford’s revenue is based upon percentages negotiated with the Tribe. These percentages are flexible and based upon ongoing services such as supporting back office work, access and updates for vehicle registration data bases, and work with tribal, state, and local authorities on codes and procedures to insure citation enforceability.

Violator Reduction Based on traffic studies conducted before the launch of the program, the presence of speed cameras has contributed to as much as an 80% - 90% decrease in the number of drivers exceeding the speed limit by 12 miles per hour or more in school zones IIHS found speed cameras reduced 59% of the amount of vehicles exceeding the speed limit by more than 10 mph compared to other road ways without speed cameras; the study was over a 7 ½ year period. IIHS study found One year after the start of ticketing, the odds of a red light running violation at the camera locations went down. Violations occurring at least 0.5 seconds after the light turned red were 39 percent less likely than would have been expected without cameras. Violations occurring at least 1 second after were 48 percent less likely, and the odds of a violation occurring at least 1.5 seconds into the red phase fell 86 percent.
