Land Division-Related Amendments Why amend these provisions now? 2002 Land Division Code Rewrite required monitoring of new regulations. Joint monitoring program set up by Bureau of Planning and Bureau of Development Services. Data was collected from submitted cases and stakeholders to create an initial list of study items. Initial list approved as part of Regulatory Improvement Workplan.

Land Division-Related Amendments Highlights of Land Division Code Related Amendments Planned Developments (PDs) Allow more PD’s to be reviewed through a Type IIx procedure. Eliminate requirement for a Final Development Plan. Allow more flexibility in meeting design requirements. Eliminate automatic Type III requirement if a change is proposed w/in 50’ of PD boundary. Street Standards Provide greater flexibility for Common Greens, Pedestrian Connections and the lots that front on these elements. Clarify requirements for public vs. private streets. Allow greater flexibility for vehicle easements for shared driveways.

Land Division-Related Amendments Highlights (contd.) Environmental Zone Issues Allow modifications to lot size through Environmental Review with additional approval criteria. Clarify Property Line Adjustment process in environmental zones. Tree Preservation Standards Provide a mitigation measure for small land division sites (under 15,000 sq. ft.). Provide clarity in Tree Preservation regulations. Clarify arborist definition and application.

Bed and Breakfast Amendments Issues: Overly restrictive regulations regarding: Maximum # of overnight guests vs. maximum # of rooms Commercial meetings and private social gatherings Recommendation: Limit # of rooms only Allow more private social gatherings for benefit of residents Provide an option for B&Bs in multi-dwelling zones to allow commercial meetings through a Conditional Use Review

Archaeological Resources in Columbia South Shore Issues: City’s current cultural plan does not recognize new archaeological studies. City would like to keep state and city inventories in sync. Zoning Code must reflect cultural plan changes. Recommendation: Amend City’s cultural plan (inventory, analysis). Amend Zoning Code in Columbia South Shore Replace term “cultural” with “archaeological”in City’s archaeological plan and code.

Historic Design Review Approval Criteria Issues: Section G applies to certain Landmarks and districts. Reference to Secretary of the Interior Standards is confusing. It is unclear how the review criteria should be evaluated. Recommendation: Remove reference to the Standards of the Secretary of the Interior. Add a clarification as to how criteria are applied.

Planning Commission Recommendation The Planning Commission recommends the following: -Adopt this report, and ordinance; -Amend the Zoning Code as shown in this report; -Amend the Cultural (Archaeological) Resources Protection Plan for Columbia South Shore as shown in this report; and -Direct staff to continue any monitoring efforts, as necessary.
