2 Accessory Structure Setback Issues Per Section 4.01.A. of the LDC, accessory structures must be typically located behind the building footprint. Somewhat confusing as the definition of “footprint” includes the area where accessory structures are located. Suggest changing “footprint” to “façade” which is defined as the exterior faces of a building facing a ROW.

3 Accessory Structure Setback Issues Continued On corner lots accessory structures must be located behind both building facades. Recently, unable to approve two swimming pools proposed in front of side street facade.

4 Proposed Colorado Drive Pool Pool deck is shown to be setback 63 feet from Columbia Lane but is not allowed as it would be in front of the side street building façade. Zoning is SFR-2 which has a minimum 20-foot front yard setback and a minimum 15- foot side street setback. As proposed it would be “OK” if it met the minimum front yard setback distance of 20 feet from Columbia Lane.

5 Proposed Pilgrim Drive Pool Pool deck is shown to be setback 39 feet from Piller Lane but is not allowed as it would be in front of the side street building façade. Zoning is SFR-3 which has a minimum 25-foot front yard setback and a minimum 20- foot side street setback. As proposed it would be “OK” if it met the minimum front yard setback distance of 25 feet from Piller Lane.

7 Proposed Key Text Changes In Section 4.01.01.A., suggest accessory structures shall be located behind the building façade rather than building footprint and add the following sentence. “On corner lots, accessory structures except for fences and walls, may be located in front of the side street building façade but shall meet the front yard setback requirements in lieu of the side street setback.”

8 Recommendation Planning staff recommends the PLDRB recommend approval of this draft ordinance as presented to the City Council.
