8. Existing Code on HOA Covenants  Sec. 38-2. Interpretation and application.  (c) In interpreting and applying the provisions of this chapter [38], they shall be held to be the minimum requirements for the promotion of the public health, safety, morals and general welfare of the community. It is not intended by this chapter [38] to interfere with, abrogate or annul any lawful easements, covenants, or other agreements between parties ; provided, however, that where this chapter imposes a greater restriction upon the use of buildings or premises than are imposed or required by other resolutions, rules, regulations, or by lawful easements, covenants or agreements, the provisions of this chapter shall control.”  Staff recommends deleting Lines 90-94, as suggested by the Planning & Zoning Commission, as the code already addresses the issue.
