DETAILED ANALYSIS MOCK TEST 12 (2013-14)

INTRODUCTION Mock Test 12 follows the pattern of Symbiosis Entrance Test (SET) wherein the students are subjected to the same level of difficulty both in terms of question type and level. The mock test comprises of five sections with a total of 150 questions of one mark each. A student is expected to attempt this test in an actual test like environment wherein he has 150 minutes to complete the test and thus needs to schedule his/her time accordingly. Section No. of QuestionsExpected Time to Complete Logical Reasoning3025 Legal Aptitude3035 Analytical Reasoning3034 Reading Comprehension3036 General Knowledge3020

LOGICAL REASONING  This section was of moderate level of difficulty. The section consisted of:  Statement – Inference (4 questions)  Statement - Assumption (4 questions)  Analogy (6 questions)  Analogy – Fill in the blanks (4 questions)  Assertion - Reason (4 questions)  Syllogism ( 4 questions)  The various questions are now described in detail:

DETAILS Question S. No. Key Concepts and Brief Description Overall Level of Difficulty Strategy 1 to 4 Statement - Inference Moderate The questions were based on interpreting the statement correctly. All four questions were doable and so, should have been attempted. 5 to 8 Statement – Assumption Moderate The questions were of moderate level of difficulty. If meddling with the assumption affects the statement, it can be safely marked as a valid assumption and the vice versa is also true. All 4 questions should have been attempted. 9 to 14AnalogyModerate These analogies were either logic based or language based. None of the question was likely to pose much problem. So, at least 5 on 6 questions should have been attempted.

DETAILS Question S. No. Key Concepts and Brief Description Overall Level of Difficulty Strategy 15 to 18Analogy (FIB) Easy- Moderate These questions required some knowledge of legal terms and punishments. At least 3 out of 4 questions should have been attempted. 19 to 22 Assertion - Reason Moderate The questions were of moderate level of difficulty. Some amount of general knowledge was required to handle them. All the questions should have been attempted. 23 to 26 Statement - Argument Moderate All the questions were of moderate level. Each word needed to be given proper attention. If you could sense a gap in the statement and argument, the argument could be considered weak and if the argument convincingly supported the argument, it should be considered strong. All questions were doable. 27 to 30SyllogiamEasy The questions on syllogism were based on basic rules of syllogism. Therefore, all the questions should have been attempted.

LEGAL APTITUDE This section had 30 questions on Legal Aptitude comprising of both Legal Reasoning as well as Legal Knowledge. The section consisted of Legal Reasoning (20 questions) Legal Knowledge (10 questions) Overall, the section was of Moderate difficulty level. The Legal Reasoning section specifically tested the ability of students to understand and interpret the legal principles and application of the same to the factual matrix to reach the best answer. And, in order to answer the questions based on Legal Knowledge, students were expected to have basic knowledge of concepts under Law of Contracts. An attempt between the range of 26-28 would be considered a good attempt for this section.

DETAILS Legal Reasoning: The Legal Reasoning part of mock 12 was very much manageable. It was dominated by questions from Law of Contracts and Torts. Then there were questions from Constitutional Law, Criminal Law, Family Law, Intellectual Property Law and General Legal Principles. A stalwart approach towards legal reasoning makes it a very scoring sub- section of the paper. Legal Knowledge: The Legal Knowledge section had a fair distribution of questions from all the subjects i.e. Criminal Law, Torts, Constitution, Law of Contracts, Family Law and general principles of law.

QUESTION ANALYSIS Question 37 - 39: This set of question consists of 5 principles and a long set of facts followed by three questions. The Principles are based on certain topics from Consumer Laws. This question is slightly different from the others as it a multiple principle based question on the topic of consumer laws, unusual than the ones usually on constitution, torts or contracts. So, one should definitely attempt this question for experience purpose. The questions that follow are also not very difficult. W.r.t question 37, Satish will not qualify as a consumer because he was sourcing Potassium for commercial purposes and going by Principle 2, any person who buys any goods for commercial purposes will not come under the purview of consumer. Hence, option (a) would be the correct answer. W.r.t question 38, Indo-Potassium will be liable for commission of restrictive trade practices because the price of Potassium and even the supply trend was affected because of the division of market areas. Hence. Option (a) would be the correct answer. W.r.t question 39, Option (b) would be the most appropriate of the options because option (a) and (c) are stating about deficiency of service but the facts did not have any service in picture.

QUESTION ANALYSIS Question 49 - 50: question 49 and 50 are based on the same set of facts which are reasonably long. However, the Principle for the same is pretty simple and easy to understand in a single reading. In Question 49, we need to figure whether The Institute of Constitutional and Parliamentary Studies will qualify to be State under Article 12. Going by the facts provided, it can be easily discerned that the institute is functionally as well as financially controlled by the Government and as the principle clearly states that a body will be considered to be State under Article 12 if it is functionally and financially controlled by the Government. Hence, Option (c) will be the correct answer. W.r.t. question 50, in the same facts situtation, if the Institute is not State within the meaning of Article 12, then Mudit will not be able to file a writ petition against the same because a writ petition can be filed only against thew the bodies which qualify to be State within Article 12. Hence, option (b) will be the correct answer.
