3 Rules that Rule James Madison Wrote a list of rights that would help ensure that people’s Liberties were protected Majority Rule helps decide the laws of the nation and the bill of rights protects the people in the minority that voted against a law. The First Amendment Made Sure that all people’s LIBERTIES were Protected

4 Speak Your Mind People Have the Freedom of Religion and the government can make NO law to support one religion over another or suppress any religion The First Amendment also Promises that people will maintain their right to freedom speech, press, and expression except in cases of Libel, slander, and clear and present Danger The First Also Protects the freedom of assembly as long as it is peaceful and NOT illegal and the freedom to petition the government for change

5 Search Party The Second Amendment protects the right to bear arms and establish state militias(which are now the National Guards) The Third Amendment protects the people from the government forcing them to house the military The Fourth Amendment protects people from illegal searches and seizures and requires a search warrant to search a person’s property Search Warrants require probable cause to be issued, but the police can conduct emergency searches with Just Cause

6 Pleading the Fifth The Fifth Amendment protects a person’s right to Due Process and for a person to be indicted before they go on trial The Fifth Amendment protects a person from Testifying against themselves in their personal trial The Fifth Amendment also prevents a person from Double Jeopardy The Fifth Amendment also protects a person’s right to property and says that in cases of eminent domains, the government has to pay a fair price for the property they are taking

7 Civil War The Sixth Amendment protects people right to a Speedy Public Trail in Criminal Cases Trials Are held in front of the Public and are given the right to an attorney, to call witnesses on their behalf, and get the right of public defense The Seventh Amendment that juries are used to decide civil cases(Cases where there has not been a crime) Civil Cases usually involve disputes over money or property

8 Last Rights The Eighth Amendment Allows for Bail to be set in Criminal cases but the Bail must be reasonable to the crime Bail can be refused or set at high levels if it is feared that the person accused of the crime is a danger to the public or a flight risk The Eighth Amendment also protects people from cruel and unusual punishment in other words the Punishment must match the crime The Death Penalty has been debated under the Eighth Amendment, but the death penalty has been deemed constitutional, but the ways we carry out the death penalty have changed

9 Everything is all right
The Ninth Amendment states that rights not specifically listed in the constitution or the Bill of Rights are not meant to be denied to the people Not being listed in the constitution does NOT mean people do NOT have those rights The Tenth Amendment States that powers not delegated to the national government or prohibited to the states are protected by the state governments
