To what extent are the current ICAO SARPs relevant for aerospace transportation vehicle operations?

Let’s start with the ICAO definition… Aircraft. Any machine that can derive support in the atmosphere from the reactions of the air other than the reactions of the air against the earth’s surface.

How does the system work?

Article 12 of Convention Rules of the Air Aircraft flying over/maneuvering within State or Carrying its nationality mark… Comply with rules and regulations there in force Each State keeps its regulations uniform with Convention

Article 37 of Convention International SARPs Uniformity in regulations, standards, procedures and organization relating to aircraft, personnel, airways, and auxiliary services To improve air navigation To this end, ICAO develops & adopts SARPs

Article 31 of Convention Certificates of Airworthiness Each aircraft engaged in international navigation shall have certificate of airworthiness Issued by State of Registry

Article 32 a) of Convention Licenses of Personnel Pilots and other operating crew members of each aircraft engaged in international navigation shall have certificates of competencies and licenses Issued by State of Registry

Article 33 of Convention Recognition of Certificates and Licenses Certificates of airworthiness and certificates of competencies and licenses issued by State of Registry shall be recognized by other States Provided that requirements are equal/above ICAO SARPs

Adapting to changing times In 1990s, it was recognized that State of Registry and State of Operator are not always same Exportable go beyond crews and aircraft Now extend to operators Clause introduced in Annex 6 Parts I and III: AOC must meet minimum standards in Annex 6 to be recognized by other States

Framework that brings it all together International recognition of: Pilot licenses Certificates of airworthiness AOCs + Article 37 of Convention Uniformity in regulations, standards, procedures

Putting the pieces together Articles in Convention are building blocks of how framework functions They allow for: Uniformity in the aviation system The export of licenses and certificates Annexes provide SARPs, including: Annex 1 — Personnel Licensing Annex 6 — Operation of Aircraft Including recognition of AOCs Annex 7 — Aircraft Nationality and Registration Marks Annex 8 — Airworthiness of Aircraft
