Capital Improvements Element  Required element in the Comprehensive Plan  Designed to consider the need for, and location and timing of, public facilities  Ensures public facilities will be available and adequate to provide acceptable levels of service (LOS)  Ensures that the Comprehensive Plan is financially feasible Overview

Concurrency  The premise of concurrency is that public facilities and services will be available concurrent with the impacts of development  Local government sets LOS standards, and concurrency ensures that those LOS standards will be achieved and maintained Overview

Level of Service (LOS) Standards  Identified for concurrency-related facilities  Parks and recreation  Roads  Schools  Solid waste  Stormwater  Water and wastewater  Provide a quantitative tool to analyze the impacts of land use changes Overview

Financial Feasibility  Must demonstrate ability to achieve and maintain adopted LOS standards  For any facilities required to achieve LOS:  Projects in FY1-FY3 must be funded through a committed funding source  Projects in FY4-FY5 may be funded by committed or planned sources Overview

Funding Sources  Committed funding source: An existing source and amount of revenue presently available to a local government  Planned funding source: A revenue source not currently available, such as a potential grant Overview

2005 Growth Management Legislation  Enacted penalties for not adopting an annual update of the Capital Improvements Element (CIE) by December 2008  CIE and Capital Improvements Schedule (CIS) must demonstrate financial feasibility Legislative Requirements

2009 Growth Management Legislation  Delayed the CIE requirements to December 2011  County’s update continued to meet the financial feasibility standards during the grace period  Department of Community Affairs (DCA) currently reviews CIE under the guidelines provided in 2009 Legislative Requirements

2011 Legislative Proposals  Further delay annual update requirement to 2013  Remove financial feasibility requirement  Allow annual adoption at local level (no state review)  Remove state-mandated concurrency for transportation, schools and parks Legislative Requirements

Summary  Few changes from the CIE Update  Identified deficiencies have been addressed by policy or with projects included on the CIS  Deficient roads or schools have been included in Long Term Concurrency Management Systems (LTCMS) CIE Update

Summary  Revised the list of backlogged Concurrency Service Areas (CSAs) for schools  Backlogged CSAs previously identified will meet LOS by 2017; backlogged CSAs added this year must meet LOS by 2020  Backlogged CSAs are addressed in the OCPS District Work Plan CIE Update

Policy Amendments  CIE1.1.13: Updates reference to the CIP  CIE : Adds language indicating that projected school LOS information and CSA boundary maps are provided annually by OCPS  CIE : Updates reference to the OCPS District Capital Outlay Plan CIE Update
