Changes at national level One of the first north south horticultural benefit-sharing agreements No legal framework in place to guide negotiations National Environmental Management Biodiversity Act passed in 2004 but regulations to implement Act not yet in place.

Contribution to poverty relief SANBI indicated that profit from the Agreement would be placed into a fund administered by the SANBI Board – used for capacity development in botany and horticulture, plant conservation and community-based environmental upliftment

Lessons learnt Agreement does not strongly commit Ball to invest directly in tech. transfer and product develop in SA. Inadequate public participation. Programme scope too wide Curtailment of royalties Need for partnerships with local SA entities.
