Island Greenway Bike Path Alternatives Alt. A – Bike Path on east side of retention pond – License with no “consideration clause” – Condition of license requires construction of FE-6 fence (min) & 50-ft clear zone; and maintenance for life of license (i.e. assuming multiple renewals) Alt. B – Bike Path on west side of retention pond – License contains “consideration clause” for fair market value (FMV) – Construction of FE-6 fence (min) & 50-ft clear zone ; and maintenance as “consideration” in first term of license – FMV payment as “consideration” in the subsequent renewals Alt. C – No Bike Path – Amend easement to include as-builts for retention pond and require construction of FE-6 fence (min) & 50-ft clear zone for public safety – No consideration required Assumption: Either license (Alt. A or Alt. B) conveys everything from west side of “Greenway” to the MOTSU boundary to the east

Potential Alternative Fence We can approve the use of a higher-rated security fence that may be more aesthetically pleasing. Examples include ornamental fences referenced (with specifications) in Unified Facilities Criteria , dated 1 October 2013 (e.g./ drawings UFC 720 & 721).
