Regulations OVERVIEW Instructional Goal The participant will develop a better understanding of how to read and understand OSHA regulations and related requirements that lead to a safer work environment during hazardous waste site activities.

REGULATION OVERVIEW l The Occupational Safety and Health Act (OSHAct) went into effect on April 28, l Employers must ensure that workers have a safe and healthy environment. l The OSHAct places responsibility on employers and employees. l The OSHAct resulted in the creation of OSHA.

The Occupational Safety and Health Act of 1970 Purpose is “...to assure so far as possible every working man and woman in the Nation safe and healthful working conditions and to preserve our human resources.” General Duty Clause 5.(a)(1)

Employee Rights l Be informed of your rights and responsibilities l Review COPIES of appropriate OSHA standards..... l Request info on health and safety from employer l Receive adequate training and info on workplace safety and health hazards l Request an OSHA investigation l Be advised of OSHA’s actions

Employee Rights l Have authorized employee rep. accompany OSHA officer. l Respond to OSHA officer questions l Observe any monitoring l Review injury/accident logs l Request a closing discussion l Submit a written request to NIOSH...

Employee Rights l Object to an abatement (written, 15 days) l Be notified by employer if there is a variance l Submit information or comment to OSHA l Exercise your rights without fear

Employee Responsibilities l Read OSHA poster l Comply with standards l Follow SOPs and wear required PPE l Report hazardous conditions to supervisor l Cooperate with OSHA l Exercise OSHAct rights in responsible manner

Employer Responsibilities l Report to nearest OSHA office within 8 hours fatal accident or hospitalization of 3 or more employees l Post work related injuries yearly - Feb. l Post OSHA poster in prominent place l Cooperate with OSHA compliance officer

HAZARD COMMUNICATION STANDARD 29 CFR The employer’s Haz Com program must include: l Conduct a chemical inventory. l Obtain and file MSDSs for all chemicals. l Label all containers. l Train employees about the hazards. l The Haz Com program must be written and available to employees.

Applicable OSHA Standards OSHA enforces standards issued under earlier Acts where they apply

HORIZONTAL AND VERTICAL STANDARDS Horizontal Standards General standards that apply to any employer in any industry. i.e. - Fire protection Vertical Standards Standards relevant only to a particular industry. i.e. - Construction standards
