What is the employer’s responsibility under this Act? “(1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees”

What is the employee’s responsibility under this Act? “(b) Each employee shall comply with occupational safety and health standards and all rules, regulations, and orders issued pursuant to this Act which are applicable to his own actions and conduct.”

An immediate danger/threat to life and health Why is this the number one order of inspection? Because a life may be saved

What are the qualifications of a catastrophe? 3 employees hospitalized from same accident 1 fatality

What section is the whistleblower protection under? Section 11( c ) of the OSH Act of 1970 What does it state? “Workers have the right to complain to OSHA and seek an OSHA inspection.” (without discrimination)

Describe what the code of federal regulations is: Each day that regulations are made by congress, they are published in the Federal Register. Each rule is then placed in one of 50 Titles. Title 29 in LABOR

15 Code of Federal Regulations (CFR)
29 CFR is all the rules for the “Department of Labor” Title 29 CFR 1910 contains all the rules for Labor in General Industry

16 State Plans What did the OSH Act allow states to do?
It allowed states “to assume responsibility for…occupational safety and health standards…” What was the stipulation? That they must “… be at least as effective...” as the federal government’s standards. How many states/territories have state plans? 25
