IMMIGRATION LAW IN THE K-12 SECTOR SD8 KOOTENAY LAKE

WEBSITE: Immigration, Refugees and Citizenship Canada IRCC – GOOGLE https://www.canada.ca/en/immigration-refugees-citizenship.html Immigration, Refugees and Citizenship Canada facilitates the arrival of immigrants, provides protection to refugees, and offers programming to help newcomers settle in Canada. It also: GRANTS CITIZENSHIP REFUGEE STATUTS LANDED IMMIGRANT STATUS STUDY PERMITS WORK PERMITS SPONSORSHIP PERMISSIONS issues travel documents (such as passports) to Canadians. The way a decision is made is often more important than the decision itself.

IMMIGRATION AND REFUGEE PROTECTION ACT – referred to as the “ACT” foreign national may not study in Canada unless authorized to do so under the Act 30(1)

Bona Fide Student – is a student who without fraud or deceit, describes to the educator or CBSA official their situation for enrollment. The onus is on the applicant to establish their legal entry into Canada and permission to stay and receive a free Ministry Funded Education.

Immigration and refugee protection Act – commonly referred to as the “ACT” states that a foreign national may not study in Canada unless authorized to do so under the “ACT”. Proof of this authorization usually comes in the form of a study permit for parent or child.

The welcome center will ask for all necessary documentation to ensure that a student qualifies for Ministry funding as a 1701 in the province of BC.

Please understand that: no matter what someone told you about how easy it is to enter and enroll children or teens in school in Canada, the reality is that the student will not be permitted to begin school until proof is provided that it is legal to do so. This will be confirmed through the district Welcome Center located at 811 Stanley Street, Nelson, BC, V1L 1N8

Birth certificates Child and parent passports Canadian immigration entry stamp ETA Study permits Work permits Rental agreements and proof of address where child and parent live Divorce papers Biological parent permission to be with remarried parent in Canada or sole custody document of parent living with child in Canada. IRCC sponsorship document – located on the IRCC website Sponsorship documents Original birth certificates with certified English translation Proof of payment for tuition if parent is attending a college or university Letter from employer if the parent is on a work permit in Canada. Biometrics (see next slide for biometrics information) Documents that may be needed to prove funding for a child are listed here Remember – an ETA or visa gives permission to travel to Canada and a permit gives permission to stay in Canada. Copies of all required documents will be kept at the Welcome Center.

Biometrics requirements for non-Canadian and non US, citizens

Who gets in? Everyone who can legally show that they have the right to study and live in Canada.

Refugees – have the same rights to any school as a domestic student and will also qualify for PTSD support.
