Appeal Conditional Use Permit #6116 McKinley School 325 South Oak Knoll Avenue City Council February 29, 2016

Appeal An Appeal “vacates” the previous decision. Appeal hearing is a de novo hearing. City Council has authority to make an entirely different decision. Approve/disapprove different requests.

Background On February 21, 2012, the City Council approved an addendum to the Joint Use Facilities Agreement between the City of Pasadena and the Pasadena Unified School District for the construction and use of the McKinley School Gymnasium. One of the conditions of the approval of the addendum requires the City to obtain the required Conditional Use Permit. As such, the Department of Human Services and Recreation submitted Conditional Use Permit #6116.

Requested Entitlement Conditional Use Permit: To allow the establishment of a Parks and Recreation Facility at the McKinley School gymnasium. Parks and Recreation Facility is defined as a noncommercial park, playground, or other recreation facility, and/or open space officially designated as a public park or recreation facility. The CUP would allow the City of Pasadena’s Department of Human Services and Recreation to use the gymnasium after school hours and on the weekends. Approval of a Conditional Use Permit is required for the establishment of a Parks and Recreation Facility in the PS (Public/Semi Public) Zoning District.

Proposed Project Activities and programs proposed include: competitive organized youth and adult sports, practice, games, clinics, tournaments, adult and youth fitness classes, along with open gym time. The City would use the gymnasium between the hours of 5:00 p.m. and 9:00 p.m. Monday through Friday, from 8:00 a.m. to 5:00 p.m. Saturdays, and from 9:00 a.m. to 5:00 p.m. on Sundays. The City estimates to use the gymnasium 48-50 weeks per calendar year. The estimated number of participants varies depending on the activity or program.

Description of Tournaments Average number of youth basketball tournaments per year: 4 Average participants in a single tournament game: 20 Average number of games at each site per tournament: 10-15 games per site Average attendance (including spectators) at tournaments per game: 50-100 varies depending upon age bracket. Younger teams tend to draw more parents and spectators in general.

Staff Recommendation Staff’s Recommendation to the Hearing Officer and to the Board of Zoning Appeals was for approval of the application: The proposed activities are consistent with activities that typically occur at a school. All activities would occur inside the gym, mitigating any potential noise impact. The use of the gymnasium by the City would provide recreation opportunities the nearby residents.

Appeal Application The appellant cited the following issues as the basis for his appeal to the City Council: Environmental Determination; Number of Attendees; Traffic and Parking; and Hours and Noise.

Response to Appeal Response to Appeal The use of the gymnasium by the Department of Human Services and Recreation would constitute a negligible expansion of the existing gymnasium use. A typical week night or weekend program occurring at the gymnasium would not involve a large number of participants or attendees, only a maximum of four tournaments per year may involve up to a maximum of 100 participants (including spectators). Parking for the majority of the programs can be accommodated at the parking lot adjacent to the gymnasium. For the four scheduled tournaments per calendar year, the event attendees would be required to park in designated parking lots along Oak Knoll Avenue. Measures will be taken to ensure participants park at the designated parking lots. In order to address the noise concerns from adjacent neighbors, Sunday events would start at 9:00 a.m. It was originally proposed to start at 8:00 a.m.

Conclusion Staff concludes that: The findings for approval of the Conditional Use Permit can be made; The project is consistent with the goals and objectives contained in the City’s General Plan; The proposed activities are consistent with activities that typically occur at a school; and The use of the gymnasium by the City would provide recreation opportunities and open space to the nearby residents.

Recommendation Adopt the Environmental Determination, that the proposed project is exempt from environmental review pursuant to the guidelines of the California Environmental Quality Act (Public Resources Code §21080(b)(9); Administrative Code, Title 14, Chapter 3, Class 1 §15301, Existing Facilities); and  Uphold the Board of Zoning Appeals’ decision and approve Conditional Use Permit #6116 with one revised condition.

Condition #11 Currently reads: The attendance at any given time shall not exceed 100 participants, except for four tournaments per calendar year. Revised condition #11: The attendance at any given time shall not exceed 100 participants, which includes spectators.
