DEI Quarterly Narrative Question 1 Summary of Grant Progress: Describe the status of your state’s implementation of the grant against the DEI workplan. Include major activities that address grant requirements (e.g. Integrated Resource Teams, Asset Development, Customized Employment, Self-Employment, Blending and Braiding Resources, or Guideposts to Success, as applicable). If grantees have nothing to report, that should be specified.

DEI Quarterly Narrative Question 2 Development and Implementation of Effective Practices and Program Model Strategies: Identify any innovative strategies the state has undertaken or implemented to achieve the DEI objectives. If grantees have nothing to report, that should be specified.

Part II – Highlights of WIOA Regulations on Disability

Development of WIOA Final Rules On July 22, 2014, the Workforce Innovation and Opportunity Act (WIOA) was signed into law. The programs within these titles below are core programs. Title I – Adult, Dislocated Worker and Youth Formula Programs administered by Labor Title II – The Adult Education and Literacy Programs administered by Education Title III- Wagner-Peyser Employment Service Program administered by Labor Title IV- Rehabilitation Act of 1973 that provide services to individuals with disabilities administered by Education

Development of WIOA Final Rules A rulemaking process occurred between the period of WIOA becoming law and the rules being publicly released. On June 30, 2016, the U.S. Departments of Labor and Education made the Final Rules publicly available. They can be found at www.doleta.gov/wioa. One of the five WIOA final rules publicly released is titled “Joint Rule for Unified and Combined State Plans, Performance Accountability, and the One-Stop Joint Provisions.”

WIOA Reforms and Disability How do WIOA reforms improve service delivery to individuals with disabilities? Promotes Physical and Programmatic Access Strategically Aligns WIOA Programs Clarifies Competitive Integrated Employment

Promotes Physical and Programmatic Access – Section 188 of WIOA The joint rules establish that all comprehensive American Job Centers and affiliated sites must be physically and programmatically accessible, as described in 29 CFR part 38, the implementing regulations of WIOA section 188. Section 188 implements the non-discrimination and equal opportunity provisions of WIOA. DOL published guidance to help states set standards through “Achieving Universal Access and Equal Opportunity – Section 188 Reference Guide” https://www.dol.gov/oasam/programs/crc/188Guide.htm

Promotes Physical and Programmatic Access – Roles and Responsibilities The State Board establishes the objective criteria and procedures. It must review and update the criteria every two years as part of the review and modification of State Plans. The Local Board applies the criteria when certifying American Job Centers every three years. Standing Committees may be established within the Local Board. One of the standing committees identified include services to individuals with disabilities.

Strategically Aligns Across WIOA Programs – State Plans State Plans - Ensuring that federal core program employment and training services are coordinated and complemented by requiring a single, 4-year strategic state plan for achieving the workforce goals of the state. 27 Unified State Plans and 30 Combined State Plans submitted. State and Local Plans must describe how the AJC will comply with the nondiscrimination requirements regarding physical and programmatic accessibility of facilities, programs, services, technology and materials, including appropriate staff training and support.

Strategically Aligns Across WIOA Programs – State Plans State Plans also include strategies surrounding Career Pathways, strategic partnerships, and regional planning. All State Plans include expected levels of performance for certain primary indicators of performance. Those indicators are the basis for negotiations that the Departments and the State used to establish negotiated levels of performance.

Strategically Aligns Across WIOA Programs – Performance Accountability Performance Accountability- Ensuring that federal investments in employment and training programs by establishing a common performance accountability system. Grantees began the process of collecting data for WIOA performance accountability on July 1, 2016. Effective July 1, 2016, the Participant Individual Record Layout (PIRL) replaced Workforce Investment Act Standardized Record Data (WIASRD) for DOL. One of the leading changes in this area is aligning data elements and definitions against disability populations. .

Clarifies Competitive Integrated Employment Competitive Integrated Employment Standard. In order to satisfy the definition of competitive integrated employment as a successful employment outcome, the employment must satisfy the requirements for all three components: Competitive earnings; Integrated location; and Opportunities for Advancement. Limitations on Use of the Subminimum Wage. Increased limitations have been placed by WIOA on the payment of subminimum wages under Section 14(c) of the Fair Labor Standards Act.

Clarifies Competitive Integrated Employment Advisory Committee. WIOA established an Advisory Committee on Increasing Competitive Integrated Employment for Individuals with Disabilities. The final report will be released on September 15, 2016.
