STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Memorandum signed by the Minister of Labor and the Minister of Education and approved by the Prime Minister of Romania on June 8th, 2014 – decision for NCQPTA to have the quality of NQA; Law no. 132/1999 has been modified by Law no. 559/15.12.2004 and NCQPTA was offered the role of National Qualifications Authority; NQA attributions are offered to the National Council for Qualifications and Professional Training of Adults (NCQPTA); Supports and coordinates the establishment of SC;

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL The main role of the sectoral committees consist in developing, upgrading and validating the qualifications, through participation of the social partners, at the sectoral activities level; The tripartite agreement regarding the National Qualifications Framework was signed in February 2005. National Qualifications Authority (NQA) is provided in this agreement signed between the Government representatives and social partners. NQA attributions are offered to the National Council for Qualifications and Professional Training of Adults (NCQPTA).

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL The sectoral committees are social dialog structures, organized in sectors established by NCQPTA (Tripartite Agreement 2005 – 23 business segments); The sectoral committees are social dialog institutions of public utility, with legal personality, organized under Law no. 132/1999 at the level of industries defined by the Collective Labour Agreement nationally in force. At industry level, just a single sectoral committee can be established .

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Establishment of a sectoral committee: association agreement of at least two federative organizations, one employer and one trade union, representative for the same branch. By exception, where the employer is a ministry, for the establishment of a sectoral committee it is necessary the association agreement of at least a representative trade union at branch and ministry level, respectively the regulatory authority which has the role of employer;

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Establishment of a sectoral committee: The trade unions confederations and the employers’ confederations representative at national level may appoint one union federation, respectively one unrepresentative employers’ federation, member and signatory of the Collective Labor Agreement at branch level; Representatives of professional associations from the sector concerned can also be part of the composition of the sectoral committee.

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Any other employers’ federation or any other union federation, representative at branch level, established by law, which express such a wish, may become a member of the sectoral committee already established, to the extent that it can prove the valid representativeness in the branch committee and for which is requesting affiliation; Of the same right also benefit the unrepresentative union / employer federations, subject to compliance with the status and according to the Law no. 132/1999;

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Sectoral committees attributions: participate in developing of national and sectoral strategies in the training field; participate in developing the regulatory framework on training, assessment and certification skills; support in promoting the training and assessment system based on skills; participate in developing and updating the qualifications from related sectors, under the coordination of the National Council for Qualifications and Professional Training of Adults.

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Sectoral committees attributions: validate the qualifications and related standards, except those acquired through higher education; recommend specialists from occupational domains in order to achieve AO, for defining the qualifications and skills and for developing and validating SO, for verifying and validating the SPP; encourage and stimulate organizations and people to participate in the professional training and in professional and technical education.

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Sectoral committees attributions: collaborate, in order to achieve their object of activity, with ministries and other bodies of central government, with autonomous administrative authorities, with national and international nongovernment organizations and other public institutions; make occupational analyses and studies regarding the demand of labour for the represented branch;

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Sectoral committees attributions: give advisory opinion to applicants for updating the Romanian Classification of Occupations; propose to the training providers the related qualifications and skills, as well as the correlation of the qualifications with the occupations which can be undertaken; establish through their own status other activities in the interest of the activity branch they represent.

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Financing the sectoral committees: from the state budget, to cover the expenses related to the operations of the technical secretariat, from the MECTS budget, through the budget for the Executive Unit of the National Council for Qualifications and Professional Training of Adults (EUNCQPTA) which becomes secondary authorising officer, as financing authority after signing a financing agreement; the number of posts for technical secretariats of the sectoral committees is two;

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Financing the sectoral committees: from revenue made through provisions of SO and related associate qualifications validation services, MECTS financed activities, based on tariffs set by the National Council for Qualifications and Professional Training for Adults, at the proposal of EUNCQPTA; from revenue made through provision of qualifications and SPP validation services, MECTS financed activities, based on tariffs set by the National Council for Qualifications and Professional Training for Adults, at the proposal of EUNCQPTA;

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Financing the sectoral committees: from own revenues which can be established from the income made through provisions of services for third parties; from other income realized through programs; from donations and / or sponsorships.

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Public utility status – right and obligations: the right to free use of public assets; the right to mention on all the prepared documents their status as public utility; the obligation to communicate, as excerpt, to the Ministry of Justice and Liberties, within 3 months of the end of the calendar year, copies of the activity reports and of the annual financial statements, accompanied by proof issued by the “Official Gazette” Autonomous Administration for the request of their publication in the Romanian Official Gazette, part IV;

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Public utility status – right and obligations: the obligation to record separately in the accounting records of Sectoral Committees the goods purchased or built with public funds. In case of dissolution of a sectoral committee, goods dereived from budgetary resources and remaining after liquidation will be distributed, by Government decision, to other sectoral committees or to public institutions with the same object of activity; the obligation to transmit to NCQPTA and UENCQPTA the activity reports and the annual financial statements.

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Law no. 1/2011 – Law of National Education – it established the National Qualifications Authority by reorganization of the NCQPTA and UENCQPTA; NQA promotes the social dialog, supports and coordinates the sectoral committees activity; At NQA level stands a board with a consultative role, formed by representatives of higher education institutions, of students, of professional associations, of central public administration, of employers, of unions and of sectoral committees.

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Law no. 1/2011 – Law of National Education: training through professional education is performing based on SPP approved by MECTS, in consultation with social partners; SPP is performed based on SO validated by SC; (professional education can be organized in vocational schools which can be independent or affiliated to technological high schools, public or private)

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Sectoral Committee of Garments, Textile and Footwear COMINTEX; Sectoral Committee of Financial Activities, Banking and Insurance; Sectoral Committee of Forestry, Wood Exploitation and Processing and Furniture Industry; Sectoral Committee of Tourism, Hotels and Restaurants; Sectoral Committee of Ferrous and Nonferrous Metallurgy and Refractory Products; Sectoral Committee from Cultural Branch;

STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL SECTORAL COMMITTEES – STRUCTURES OF SOCIAL DIALOGUE AT SECTORAL LEVEL Sectoral Committee for the Automotive Industry; Sectoral Committee of Administration and Public Services; Sectoral Committee of Agriculture, Fish Breeding and Fishing; Sectoral Committee for Professional Training in Environment Protection; Sectoral Committee of Transportation; Sectoral Committee of Construction; Sectoral Committee in Chemistry and Petrochemistry.
