January 20, 1801 Adams appoints 42 Judges before leaving office (midnight appointments) Adams appoints John Marshall Chief justice of the Supreme Court William Marbury was another appointment. Adams’ the Secretary of State fails to deliver appointment

March 4, 1801 Thomas Jefferson takes office as President Soon after Marbury asks Madison (Jefferson’s Secretary of State) for his appointment. Jefferson refuses to appoint Marbury.

Marbury appeals to the Supreme Court Requests a writ of Mandamus (Orders public officials to carry out his duties) Marbury argues that he was entitled to his appointment.

Circumstances 1800 Thomas Jefferson wins election Adams loses Before leaving Adams appoints Marshall for Justice. Marshall fails to deliver the appointment to Marbury

Marbury asks Pres. Jefferson for appointment, he refuses. Marbury asks Supreme Court for a Writ to get his appointment.

Decision John Marshall gave the unanimous decision. Judiciary Act of 1789 was deemed unconstitutional Marbury was not appointed.

Impact The Constitution is the Supreme Law of the land. Supreme Court has the power of Judicial Review and can declare a law unconstitutional.
