Action Requested Approve Amendment No. 2 to Sundt Construction, Inc.’s Construction Manger At Risk Contract in the Amount of $7,798,990 for ASC Construction and $33,459 for pre-construction services for the retail portion of the project.

Background This amendment approves the construction of American Sports Center and pre-construction services for the retail portion adjacent to the facility: ◦83,000sf recreation facilities ◦Indoor Soccer fields ◦Basketball and Volleyball courts ◦Multipurpose rooms, offices, restrooms ◦Temporary parking lot

Discussion Sundt submitted a conceptual estimate of $8,687,497 on October 8, Negotiations resulted in a final contract price of $7,798,990. Strategies: ◦Utilized comparable market rates of work ◦Maximized project management efficiencies.

Furniture, Fixtures & Equipment City has $1.5 million allocated for facility furnishings & Equipment City to procure these items directly

LEED Certification LEED features included in design Solar Photovoltaic panels will be needed to achieve certification Building structural design provides the foundation for roof mount solar panels City will issue Request for Proposals from Solar companies

Schedule Council approval – January 4, 2010 Start construction – December 2010 Substantial completion – September 30, 2010 Final acceptance – October 29, 2010

Recommendation Staff recommends that the City Council approve Amendment No. 2 to Sundt Construction, Inc.’s Contract in the Amount of $7,798,990 to construct the ASC Facility and increase the pre-construction services for the retail portion in the amount of $33,459.
