1 PROGRAMME 3: MINERAL REGULATION PURPOSE: TO REGULATE THE MINERALS AND MINING SECTORS TO ACHIEVE TRANSFORMATION AND SUSTAINABLE DEVELOPMENT. OBJECTIVE: TO TRANSFORM THE MINERALS AND MINING SECTORS INTO ONE THAT COMPETITIVELY CONTRIBUTES TO SUSTAINABLE DEVELOPMENT IN S.A. SERVICE DELIVERY OVERVIEW: THE BRANCH IS IN ITS FOURTH YEAR. BY END 2009, THE DEPARTMENT HAS RECEIVED APPLICATIONS: ACCEPTED; 3653 REJECTED AND 5806 ISSUED.

3 PROGRAMME 3: MINERAL REGULATION [continued] ENVIRONMENTAL MANAGEMENT INSPECTIONS: INSPECTIONS RELATING TO MINING AND PROSPECTING WORK PROGRAMMES [MONITORING AND COMPLIANCE]: INTERNAL TRAINING WORKSHOPS: PROSPECTING WORK PROGRAMME AND MINING WORK PROGRAMME GUIDELINES: 2 DEVELOPED AND APPROVED

4 PROGRAMME 3: MINERAL REGULATION [continued] (i)31 Infrastructure projects [including multipurpose centres, clinics, libraries, schools, training centres, water supply, etc.] (ii)864 Jobs created through new mining projects. 881 jobs created through enterprise development. (iii)A number of BEE compliance inspections were executed during the 2008/09 financial year. (iv)The branch [though not completely within the ambit of its mandate] intervened in some disputes between communities and mining companies.

6 Actively contribute to sustainable development and growth 1.Contribute to skills development - Measures are the number of Scholarships (target:500), learnerships (target:1000) and internships (target:200) - Measures are the number of employees in Adult Basic Education & Training (ABET) (target:5000) - Measures are the number of women in mining related courses (target: 500) and management related courses (target :100) - Measures are the number of HDSA in mining related courses (target:1000) and management related courses (target: 300)

7 Actively contribute to sustainable development and growth (Cont’d) 2.Promote Sustainable Resource Management - Measures are the number of infrastructure development projects (target:27) - Measures are the number of income generating projects (target:18) 3.Promote Job Creation - Jobs will be created from point 2 above - Measures are the number of SMME development projects (target:27)

8 Promote and transform the mineral sector 4.Regulate Mineral and Mining Sector to achieve transformation - Measure will be the number of rights granted to HDSA’s (target:27) - Measure will be the extent of company compliance with 40% HDSA in Management and 10% women in management (Targets are 100%)(in line with the Mining Charter) - Measure will be the number of licensed women (target: 18) and youth led (target:27) companies in the mining sector

9 Promote and transform the mineral sector (Cont’d) 5.Educate and Communicate with Stakeholders - The measure will be the number of workshops conducted with mineral and mining industry stakeholders (Target: 10)

10 Internal business processes 6.Monitor and enforce compliance - The Branch seeks to achieve 100% compliance with regulatory requirements. - Measure will be the number of Mining Charter and legal compliance inspections (target:140) - Measure will be the number of Mining and Prospecting work programme inspections (target : 302) - Measure will be the number of Social and Labour Plan inspections (target:140) - Measure will be the number of environmental management plan \ programme inspections (target: 1380) 7.Improve turnaround times - Adherence to prescribed time frames ( Revision of turn around times undertaken; i.e. mining rights will be finalised within a six month period whilst prospecting rights will be finalised within three months.

Develop and review internal processes - Measure will be the review and approval of guidelines i.r.o. * Registration of rights (1) * Consultation process (1)Inputs will be provided to the Mineral Policy and Promotion Branch) * Mining work programme and prospecting work programme (1 each) * Social and Labour Plan guidelines review planned for 2011/ Reduce State’s environmental liability - Identify and prioritise unsafe and unrehabilitated ownerless and derelict mines - Implementation of identified ownerless and derelict mine rehabilitation projects - Review current operations i.r.o. adequacy of funding for rehabilitation - Mines closing without residual State liability
