Eagle Heights Development Proposal Consists of two sets of development applications and two property ownerships: Paletta and Taylor lands. Paletta is applicant for both properties. The development applications have been submitted for: –Official Plan Amendments –Zoning By-law Amendments –Plan of Subdivision

Area Sketch of Subject Lands Paletta lands: 97 ha (240 ac) Taylor lands: 9 ha (22 ac) Total of 870 units proposed on subject lands.

Proposed Development (Paletta) 815 residential units comprised of various housing forms, park block, institutional block, open space areas, valley lands and stormwater management ponds including: 171 detached dwelling units 338 apartment units within four-4 storey buildings (Areas 1-4) 20 detached condominium units (Area 5) 286 townhouse units (Areas 6- 11) One (1) institutional block (e.g. Area 12). One (1) park block (Area 13). Four (4) stormwater management ponds. Ravines and open space areas throughout the project. Roads

Proposed Development (Taylor) 55 residential units and open space including: 31 detached dwelling units 24 townhouse units One (1) stormwater management pond Ravines and open space areas Roads

Development Application Chronology (I) 1992:Grindstone Settlement Area Landowners Group (GSA): Applications for 1,100 units. Applicants appealed :North Aldershot Inter-Agency Review (NAIR) Study Burlington initiated; Burlington and Region approved study in 1994 City recommended 232 residential units in the Central Sector :OMB Hearing & Settlement. 409 unit settlement approved by OMB in Fall 1996 (363 for Paletta) and 46 for Taylor)

2002: Development Applications Submitted City returned the applications as they were considered incomplete. Applicants initiated an appeal City position: OMB could not adjudicate since applications were incomplete :Court Decisions Applicant challenged City’s position before Superior Court of Justice. Superior Court ruled in favour of applicant. Burlington appealed decision before Court of Appeal. Court of Appeal ruled in favour of the applicant. Development Application Chronology (II)

Development Application Chronology (III) 2004: Submission of Applications Applications for 665 units. City did not adopt position. 2007: Revised Applications 870 units. Proposal not circulated. 2009: Minutes of Settlement City and Paletta entered into negotiations on several properties including Eagle Heights. 2010: Revised Applications 870 units. Studies submitted and applications were circulated.

City’s Comments March 9, 2012 Letter to Paletta Letter provides: the planning framework in which City is evaluating the applications (e.g OMB decision, Official Plan policies (Region and City); Provincial policy and regulations; Minutes of Settlement; NAIR.) summary of public and technical comments; preliminary City comments; and summary of next steps in review process.

Summary of Public Comments: Key Themes North Aldershot is defined by rural character; this should not be changed. No basis to change from the extensive planning that has occurred. Info management and public engagement are important considerations. Various design considerations and innovations required. Traffic impacts. Site-specific comments.

Summary of Technical Comments Applications were circulated to various agencies (e.g. agencies of gov’t; advisory groups; utilities). Substantive comments received from Conservation Halton, Region of Halton, and Ministry of Natural Resources. Common theme: significant additional information is required.

Summary of City Comments Letter discussed issues including: environmental issues growth management policies including financial considerations transportation community design (e.g. visual impact, area character) provision of parkland and stormwater management Noted that addendums are required to: confirm developable areas (sub-areas) provide additional information

Conclusion of City’s Letter Letter covers areas of concern and questions raised by the City, agencies and the public. It does not establish a staff position on the applications. Concluded that: the City is open to fair consideration of increased density in the context of provincial and local planning objectives; the ecosystem planning approach remains relevant as identified in NAIR; additional information is required in order to enable the City to advance the applications.

Next Steps City’s Role: Provided preliminary comments and will facilitate discussion with Paletta and agencies. Upon obtaining information, staff will continue to process the applications and will prepare a report to Committee and Council. Will conduct public engagement. Paletta’s Role: Respond to public and agency comments. Provide additional information. Address agency concerns and questions. Public’s Role: Public will be invited to additional engagement opportunities.
