False Identification Use a fake I.D.....Lose your license. -It is illegal for anyone under 21 to possess alcohol with the intent to consume it. -It’s also against the law for anyone under 21 to use fake identification to purchase alcohol. Tampering with a New York State (or any state) driver’s license can result in the loss of that license for 90 days.

Underage Drinking and Driving has been illegal since 1985 to drink alcohol if you’re under 21 The Zero Tolerance Law (1996) : if you’re under 21, and found to have been driving with a blood alcohol concentration (BAC) of.02% — one drink — or higher, you’ll lose your license for at least six months. -You will also have to pay a $125 fine and an additional $100 to get your license back.

If it happens again, your license will be revoked for one year or until you turn 21, whichever is later. -You will also be fined and pay additional fees to get your license back. If you have a BAC of.07% or more, even tougher DWI/DWAI penalties will be imposed, including possible jail terms.

***IF YOU ARE CLOSE ENOUGH TO touch THE ALCOHOL, EVEN IF YOU ARE NOT DRINKING, YOU CAN GET CHARGED WITH AN M.I.P. (the law reads “close proximity”) SO, IF YOU ARE AT A PARTY (even if you are not drinking) YOU CAN GET IN TROUBLE WITH THE LAW!!! ***IN A CAR, EVERYONE IN THE CAR CAN BE CHARGED WITH AN M.I.P. IF THERE IS A CAN IN THE CAR OR TRUNK. (EVEN IF IT’S not opened, OR IT’S empty ). If you are 21, it can be in trunk.

1. M.I.P. caught with alcohol at a party, or drinking if driving and under.02 Possible Consequences: 1st offense -could get diversion, or lose license until 17 or 1 year 2nd offense- lose license until 18 or 2 years *Any M.I.P. conviction stays on your record forever!

**MINOR: UNDER 21** NOT DRIVING:M.I.P. DRIVING: if under.02: M.I.P. if : zero tolerance policy which is a misdemeanor / may also be charged with M.I.P..08 or higher: D.U.I. (same as adult) Under the influence of any drug, including marijuana: D.U.I.. *IMPLIED CONSENT: You do NOT have the right to refuse when you sign your drivers’ license you say you will take a breathalyzer test

3. D.U.I. - driving with.08 or higher (treated the same as adult) Possible Consequences: 1st offense - at least 90 days license suspension, at least 1 day in jail or electric home monitoring, fines to $8,125.00, and possible ignition interlock (costs $10.00 day = $ a month!)
